운전면허를 받으려는 사람은 운전면허시험에 합격하여야 한다.

운전면허의 효력은 본인 또는 대리인이 제2항부터 제4항까지에 따른 운전면허증을 발급받은 때부터 발생한다. 이 경우 제3항 또는 제4항에 따라 운전면허의 범위를 확대하거나 축소하는 경우에도 제93조에 따라 받게 되거나 받은 운전면허 취소ㆍ정지처분의 효력과 벌점은 그대로 승계된다. <개정 2014.12.30>
