제97조 자동차등의 운전 금지

제96조에 따라 국제운전면허증 또는 상호인정외국면허증을 가지고 국내에서 자동차등을 운전하는 사람이 다음 각 호의 어느 하나에 해당하는 경우에는 그 사람의 주소지를 관할하는 시ㆍ도경찰청장은 행정안전부령으로 정한 기준에 따라 1년을 넘지 아니하는 범위에서 국제운전면허증 또는 상호인정외국면허증에 의한 자동차등의 운전을 금지할 수 있다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2020.6.9, 2020.12.22, 2021.1.12, 2021.10.19>
1. 제88조제1항에 따른 적성검사를 받지 아니하였거나 적성검사에 불합격한 경우
2. 운전 중 고의 또는 과실로 교통사고를 일으킨 경우
3. 대한민국 국적을 가진 사람이 제93조제1항 또는 제2항에 따라 운전면허가 취소되거나 효력이 정지된 후 제82조제2항 각 호에 규정된 기간이 지나지 아니한 경우
4. 자동차등의 운전에 관하여 이 법이나 이 법에 따른 명령 또는 처분을 위반한 경우

Where the person has not undergone or has failed the aptitude test under Article 88 (1). 2. Where the person has caused a traffic accident due to intent or negligence while driving. 3. Where a person with Republic of Korea nationality has had their driver's license revoked or suspended under Article 93 (1) or (2) and the period prescribed in each subparagraph of Article 82 (2) has not yet elapsed. 4. Where the person has violated this Act or any order or disposition under this Act concerning the driving of motor vehicles, etc.
제1항에 따라 자동차등의 운전이 금지된 사람은 지체 없이 국제운전면허증 또는 상호인정외국면허증에 의한 운전을 금지한 시ㆍ도경찰청장에게 그 국제운전면허증 또는 상호인정외국면허증을 제출하여야 한다. <개정 2020.12.22, 2021.10.19>

시ㆍ도경찰청장은 제1항에 따른 금지기간이 끝난 경우 또는 금지처분을 받은 사람이 그 금지기간 중에 출국하는 경우에는 그 사람의 반환청구가 있으면 지체 없이 보관 중인 국제운전면허증 또는 상호인정외국면허증을 돌려주어야 한다. <개정 2020.12.22, 2021.10.19>
