제114조 군인 등에게 판매하는 물품에 대한 개별소비세와 주세의 면제

군이 직영하는 매점에서 대통령령으로 정하는 군인, 군무원과 태극ㆍ을지무공훈장 수훈자에게 판매하는 물품(국내에서 제조된 물품만 해당한다)에 대해서는 개별소비세와 주세를 면제한다.
Individual consumption tax and liquor tax shall be exempted on goods (limited to goods manufactured in the Republic of Korea) sold at canteens directly managed by the military to soldiers, military civilian employees, and recipients of the Taeguk and Eulji National Security Merit Medals as prescribed by Presidential Decree.
국방부장관은 재정경제부장관과 협의하여 매 연도분의 물품별면세한도량을 그 전년도 12월 31일까지 결정하여야 한다. <개정 2025.10.1>
The Minister of National Defense shall determine, in consultation with the Minister of Economy and Finance, the duty-free limit for each type of goods for each fiscal year by December 31 of the preceding year. <Amended by Act No. xxxx, October 1, 2025>
제1항에 따라 면세되는 물품에 대해서는 국세청장이 정하는 바에 따라 해당 물품 또는 그 포장 및 용기에 면세물품임을 표시하여야 한다.
Goods exempted from tax under paragraph ① shall be marked as duty-free goods on the goods themselves, their packaging, or containers, as determined by the Commissioner of the National Tax Service.
제1항에 따라 면세되는 주류의 원료용 주류의 주세액에 상당하는 금액은 환급하거나 공제하되, 이에 관하여는 「주세법」 제19조제3항을 준용한다. <개정 2021.12.28>
The amount equivalent to the liquor tax on liquor used as raw material for liquor exempted from tax under paragraph ① shall be refunded or credited, and Article 19 (3) of the the Liquor Tax Act shall apply mutatis mutandis. <Amended by Act No. xxxx, December 28, 2021>
제1항에 따른 면세대상물품의 범위, 면세절차 및 징수에 필요한 사항은 대통령령으로 정한다.
The scope of goods eligible for exemption under paragraph ①, the exemption procedures, and other matters necessary for collection shall be prescribed by Presidential Decree.
