제99조의14 연금계좌 납입에 대한 양도소득세의 과세특례

다음 각 호의 요건을 모두 충족하는 거주자가 보유기간 등을 고려하여 대통령령으로 정하는 부동산을 2027년 12월 31일까지 양도하고, 그 양도일부터 6개월 이내에 양도가액의 전부 또는 일부를 「소득세법」 제20조의3제1항제2호에 따른 연금계좌에 납입하는 경우에는 연금계좌 납입액의 100분의 10에 상당하는 금액을 해당 부동산의 양도소득 산출세액에서 공제한다. 이 경우 공제세액은 산출세액을 한도로 한다.
1. 부동산 양도 당시 「기초연금법」 제2조제3호에 따른 기초연금 수급자일 것
2. 부동산 양도 당시 1주택 또는 무주택 세대의 구성원일 것
Where a resident who meets all of the following requirements sells real estate designated by Presidential Decree, taking into account the holding period, etc., by December 31, 2027, and contributes the entire amount or a portion of the sale price to a pension account under Article 20-3 (1) 2 of the Income Tax Act within 6 months from the date of sale, an amount equivalent to 100/10 of the contribution to the pension account shall be deducted from the calculated capital gains tax on the sale of the real estate. In this case, the deducted tax amount shall be limited to the calculated tax amount. 1. The person shall be a recipient of basic pension under Article 2 (3) of the Basic Pension Act at the time of selling the real estate. 2. The person shall be a member of a household owning one house or no house at the time of selling the real estate.
제1항에 따라 양도소득세를 공제받은 자가 같은 항에 따른 납입액의 전부 또는 일부를 대통령령으로 정하는 바에 따라 해당 연금계좌에서 연금수령 외의 방식으로 인출하는 경우에는 그 공제받은 세액에 상당하는 금액을 양도소득세로 납부하여야 한다.
If a person who receives a deduction of capital gains tax under paragraph ① withdraws all or part of the contribution amount referred to in the same paragraph from the pension account in a manner other than receiving it as a pension, as prescribed by Presidential Decree, an amount equivalent to the deducted tax shall be paid as capital gains tax.
제1항을 적용할 때 공제의 신청 절차, 제출 서류, 그 밖에 필요한 사항은 대통령령으로 정한다.
When applying paragraph ①, the procedures for applying for deduction, documents to be submitted, and other necessary matters shall be prescribed by Presidential Decree.
