Article 8-2 (Collection of Reimbursement Funds)
제8조의2 변제금의 징수

고용노동부장관은 제7조 또는 제7조의2에 따라 근로자에게 대지급금을 지급한 경우에는 제8조제1항에 따라 미지급 임금등을 청구할 수 있는 권리를 대위하여 해당 사업주에게 그에 해당하는 금액(이하 "변제금"이라 한다)을 납부할 것을 기한을 정하여 통지하여야 한다.
Where the Minister of Employment and Labor has paid a substitute payment to a worker pursuant to Article 7 or 7-2, the Minister of Employment and Labor shall notify the employer, by setting a deadline, to pay the corresponding amount (hereinafter referred to as "reimbursement funds"), by subrogation of the right to claim unpaid wages, etc. pursuant to Article 8 (1).
변제금의 징수에 관하여는 고용산재보험료징수법 제25조, 제26조의2, 제27조, 제27조의2, 제28조, 제28조의2부터 제28조의5까지, 제28조의7, 제29조, 제32조 및 제42조(제1항제3호ㆍ제4호 및 제2항제2호부터 제5호까지로 한정한다)를 준용한다. 이 경우 "납부의무자"는 "사업주"로, "보험료" 및 "보험료, 환수금"은 각각 "변제금"으로, "공단" 또는 "건강보험공단"은 각각 "고용노동부장관(이 법 제27조에 따라 그 권한을 위탁한 경우에는 그 위탁받은 자를 말한다)"으로 본다.
With respect to the collection of reimbursement funds, Articles 25, 26-2, 27, 27-2, 28, 28-2 through 28-5, 28-7, 29, 32, and 42 of the Employment and Industrial Accident Insurance Premium Collection Act (limited to Article 1 (3) and (4), and Article 2 (2) through (5)) shall apply mutatis mutandis. In this case, "the person liable for payment" shall be deemed "the employer," "insurance premiums" and "insurance premiums, recovery funds" shall be deemed "reimbursement funds," respectively, and "the Corporation" or "the National Health Insurance Service" shall be deemed "the Minister of Employment and Labor (referring to the entrusted person when the authority is entrusted pursuant to Article 27 of this Act)," respectively.
변제금의 납부 기한 및 그 밖에 변제금 징수에 필요한 사항은 대통령령으로 정한다.
The deadline for payment of reimbursement funds and other matters necessary for the collection of reimbursement funds shall be determined by Presidential Decree.
