Article 14-6 (Agency for Specific Items of Municipal Waste)
제14조의6 생활폐기물 중 특정 품목의 대행

특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장은 제14조제2항에 따라 생활폐기물의 처리를 대행하게 하는 경우 폐지, 고철, 폐합성수지 등 지방자치단체의 조례로 정하는 폐기물(이하 이 조에서 "특정 품목"이라 한다)의 수집ㆍ운반 또는 재활용을 별도로 대행하게 하는 계약(이하 "대행계약"이라 한다)을 체결할 수 있다.
The Special Mayor, Special Governor, Mayor, County Governor, or District Head may enter into a separate contract (hereinafter referred to as a "Consignment Contract") for the collection, transport, or recycling of waste designated by ordinance of the local government, such as waste paper, scrap metal, and waste synthetic resins (hereinafter referred to as "Specific Items" in this Article), when entrusting the processing of municipal waste pursuant to Article 14 (2).
특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장은 대행계약을 체결한 대행자가 다음 각 호의 어느 하나에 해당하는 경우에는 대행계약을 해지할 수 있다. <개정 2025.10.1>
1. 대행계약이 체결된 특정 품목 중 일부 품목의 수집ㆍ운반 또는 재활용을 회피하거나 거부한 경우
2. 분리배출된 품목을 혼합하여 수집ㆍ운반하거나 보관한 경우
3. 처리 능력의 초과 등 정당한 사유 없이 대행계약을 이행하지 아니한 경우
4. 그 밖에 기후에너지환경부령으로 정하는 경우
The Special Mayor, Special Governor, Mayor, County Governor, or District Head may terminate a Consignment Contract if the entrusted party falls under any of the following subparagraphs: <Amended by 2025.10.1> 1. Refusal or evasion of the collection, transport, or recycling of some of the Specific Items for which the Consignment Contract was entered into. 2. Collection, transport, or storage of separated items mixed together. 3. Failure to perform the Consignment Contract without justifiable grounds, such as exceeding processing capacity. 4. In other cases as prescribed by the Minister of Climate, Energy, and Environment.
특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장은 대행계약을 체결한 경우 재활용 시장의 변동 등으로 계약금액을 조정할 필요가 있을 때에는 기후에너지환경부령으로 정하는 바에 따라 계약금액을 조정할 수 있다. <개정 2025.10.1>
The Special Mayor, Special Governor, Mayor, County Governor, or District Head may adjust the contract price as prescribed by the Minister of Climate, Energy, and Environment when it is necessary to adjust the contract price due to fluctuations in the recycling market, etc., after entering into a Consignment Contract. <Amended by 2025.10.1>
특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장은 대행계약으로부터 얻은 수익금을 기후에너지환경부령으로 정하는 바에 따라 특정 품목의 배출자에게 지원하여야 한다. <개정 2025.10.1>
The Special Mayor, Special Governor, Mayor, County Governor, or District Head shall support the persons who generated the Specific Items with the profits obtained from the Consignment Contract, as prescribed by the Minister of Climate, Energy, and Environment. <Amended by 2025.10.1>
특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장은 대행계약을 체결(대행계약의 변경을 포함한다)하거나 제3항에 따라 계약금액을 조정한 경우 기후에너지환경부령으로 정하는 바에 따라 그 내용을 해당 지방자치단체 인터넷 홈페이지에 공개하여야 한다. <개정 2025.10.1>
The Special Mayor, Special Governor, Mayor, County Governor, or District Head shall disclose the details of the Consignment Contract (including any amendments thereto) or the adjusted contract price pursuant to paragraph (3) on the Internet homepage of the relevant local government, as prescribed by the Minister of Climate, Energy, and Environment. <Amended by 2025.10.1>
