제37조 휴업과 폐업 등의 신고

폐기물처리업자, 폐기물처리 신고자, 폐기물분석전문기관 또는 전용용기 제조업자는 그 영업을 휴업ㆍ폐업 또는 재개업한 경우에는 기후에너지환경부령으로 정하는 바에 따라 그 사실을 허가, 신고, 지정 또는 등록관청에 신고하여야 한다. 재활용환경성평가기관도 또한 같다. <개정 2010.7.23, 2015.1.20, 2015.7.20, 2025.10.1>
A waste treatment business operator, a waste treatment reporting person, a waste analysis specialist agency, or a dedicated container manufacturer shall report such fact to the permitting, reporting, designating, or registering authority when suspending, ceasing, or resuming business, in accordance with the matters prescribed by the Ordinance of the Minister of Environment. 기후에너지환경부장관 또는 시ㆍ도지사는 제1항에 따른 신고를 받은 날부터 20일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2017.4.18, 2025.10.1>
The Minister of Environment or the head of a Metropolitan City, Do, or Special Self-Governing Province shall notify the reporting person of whether to accept the report within 20 days from the date of receiving the report under paragraph ①. <Newly Inserted by Act No. 14176, Apr. 18, 2017, Act No. 19740, Oct. 1, 2025>
기후에너지환경부장관 또는 시ㆍ도지사가 제2항에서 정한 기간 내에 신고수리 여부나 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2017.4.18, 2025.10.1>
If the Minister of Environment or the head of a Metropolitan City, Do, or Special Self-Governing Province fails to notify the reporting person of whether to accept the report or of the extension of the processing period under the laws and regulations concerning civil petition processing within the period prescribed in paragraph ②, the report shall be deemed accepted on the day following the expiration of such period. <Newly Inserted by Act No. 14176, Apr. 18, 2017, Act No. 19740, Oct. 1, 2025>
제1항에 따라 휴업 또는 폐업의 신고를 하려는 자(폐기물처리업자와 폐기물처리 신고자로 한정한다)는 기후에너지환경부령으로 정하는 바에 따라 보관하는 폐기물을 전부 처리하여야 한다. <신설 2010.7.23, 2015.1.20, 2017.4.18, 2025.10.1>
