제48조의5 과징금

기후에너지환경부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제48조제1항제1호부터 제8호까지의 규정 중 어느 하나에 해당하는 자가 폐기물을 부적정 처리함으로써 얻은 부적정처리이익(부적정 처리함으로써 지출하지 아니하게 된 해당 폐기물의 적정 처리비용 상당액을 말한다. 이하 이 조에서 같다)의 3배 이하에 해당하는 금액과 폐기물의 제거 및 원상회복에 드는 비용을 과징금으로 부과할 수 있다. <개정 2025.10.1>
The Minister of Climate, Energy and Environment, the head of a special metropolitan city, metropolitan city, or provincial government, or the head of a city, county, or district may impose an administrative fine not exceeding three times the amount of profit obtained from improper waste disposal (meaning the amount equivalent to the proper disposal cost that would have been incurred for improper disposal, hereinafter the same in this Article) by a person falling under any of the provisions of Article 48(1) 1. to 8., and the costs of waste removal and restoration to the original state.
기후에너지환경부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제1항에 따른 과징금을 내야 할 자가 납부기한까지 내지 아니하면 국세 체납처분의 예 또는 「지방행정제재ㆍ부과금의 징수 등에 관한 법률」에 따라 징수한다. <개정 2025.3.25, 2025.10.1>
If a person liable to pay an administrative fine under paragraph ① fails to pay it by the due date, the Minister of Climate, Energy and Environment, the head of a special metropolitan city, metropolitan city, or provincial government, or the head of a city, county, or district shall collect it in accordance with the provisions on collection of delinquent national taxes or the 「Act on the Collection of Local Administrative Sanctions and Fines」.
제1항에 따라 과징금을 부과할 때 「환경범죄 등의 단속 및 가중처벌에 관한 법률」 제12조에 따라 과징금이 부과된 경우에는 그에 해당하는 금액을 감액한다.
When imposing an administrative fine under paragraph ①, if an administrative fine has been imposed under Article 12 of the 「Act on the Crackdown on and Aggravated Punishment of Environmental Crimes, etc.」, the amount corresponding thereto shall be reduced.
제1항에 따른 과징금의 구체적인 계산방법과 그 밖에 필요한 사항은 대통령령으로 정한다.
The specific calculation method of administrative fines under paragraph ① and other necessary matters shall be determined by Presidential Decree.
