법 제28조에 따라 사업주가 지원받을 수 있는 직업능력개발 훈련비용의 연간 총액은 그 사업주가 고용산재보험료징수법 제13조제1항제1호 및 제16조의3에 따라 부담하는 해당 연도 고용보험료 중 고용안정ㆍ직업능력개발사업의 보험료 또는 그 사업주가 고용산재보험료징수법 제13조제1항제1호 및 제17조제1항에 따라 해당 연도에 납부해야 할 고용보험 개산보험료 중 고용안정ㆍ직업능력개발사업의 보험료의 100분의 100(우선지원대상기업의 경우에는 100분의 240)에 해당하는 금액으로 한다. 다만, 제18조제2항 각 호의 어느 하나에 해당하는 사업주에게 지원할 수 있는 비용의 총 한도는 그 사업주가 부담하는 해당 연도 고용보험료 중 고용안정ㆍ직업능력개발사업의 보험료 또는 그 사업주가 해당 연도에 납부해야 할 고용보험 개산보험료 중 고용안정ㆍ직업능력개발사업의 보험료의 100분의 130(우선지원대상기업의 경우에는 100분의 300)으로 할 수 있다. <개정 2010.12.31, 2016.7.19, 2021.6.8, 2021.12.31>
The total annual amount of vocational skills development training expenses that an employer may receive support for under Article 28 of the Act shall be 100 percent (240 percent for preferential support target enterprises) of the insurance premium for employment stabilization and vocational skills development projects among the employment insurance premiums the employer bears for the relevant year under Articles 13 (1) 1 and 16-3 of the Employment Insurance Premium Collection Act, or the insurance premium for employment stabilization and vocational skills development projects among the provisional employment insurance premiums the employer must pay for the relevant year under Articles 13 (1) 1 and 17 (1) of the Employment Insurance Premium Collection Act. However, the total limit of expenses that can be supported for an employer falling under any of the subparagraphs of Article 18 (2) may be 130 percent (300 percent for preferential support target enterprises) of the insurance premium for employment stabilization and vocational skills development projects among the employment insurance premiums the employer bears for the relevant year, or the insurance premium for employment stabilization and vocational skills development projects among the provisional employment insurance premiums the employer must pay for the relevant year. <Amended on Dec. 31, 2010, Jul. 19, 2016, Jun. 8, 2021, Dec. 31, 2021>
사업주가 자신의 사업 외의 다른 사업에 고용된 근로자를 대상으로 「국민 평생 직업능력 개발법」 제24조에 따라 훈련과정을 인정받아 훈련을 실시하는 경우에는 제1항에 따른 지원금 외에 그 사업주가 부담하는 해당 연도 고용보험료 중 고용안정ㆍ직업능력개발사업의 보험료 또는 그 사업주가 해당 연도에 납부하여야 할 고용보험 개산보험료 중 고용안정ㆍ직업능력개발사업의 보험료의 100분의 80까지 추가로 지원할 수 있다. <개정 2010.12.31, 2016.7.19, 2022.2.17>
Where an employer provides training by receiving recognition for a training course under Article 24 of the Lifelong Vocational Skills Development Promotion Act for workers employed in a business other than their own, additional support of up to 80 percent of the insurance premium for employment stabilization and vocational skills development projects among the employment insurance premiums the employer bears for the relevant year, or the insurance premium for employment stabilization and vocational skills development projects among the provisional employment insurance premiums the employer must pay for the relevant year, may be provided in addition to the support funds under paragraph ①. <Amended on Dec. 31, 2010, Jul. 19, 2016, Feb. 17, 2022>
제1항과 제2항에도 불구하고 지원금액이 기업의 규모ㆍ업종 등을 고려하여 고용노동부장관이 정하는 비용지원한도 최소금액에 미달하는 경우에는 고용노동부장관이 정하는 비용지원한도 최소금액을 지원금액으로 한다. <개정 2010.7.12>
Notwithstanding paragraphs ① and ②, if the amount of support funds is less than the minimum expense support limit determined by the Minister of Employment and Labor, considering the company's size, industry type, etc., the minimum expense support limit determined by the Minister of Employment and Labor shall be the amount of support funds. <Amended on Jul. 12, 2010>
다음 각 호의 어느 하나에 해당하는 지원금은 제1항부터 제3항까지의 규정에 따라 해당 사업주가 지원받을 수 있는 직업능력개발 훈련비용지원의 한도액에 포함되지 않는다. <개정 2013.12.24, 2016.7.19, 2018.7.3, 2020.9.29, 2021.6.8, 2021.12.31, 2022.2.17>
1. 제41조제1항제1호에 따른 직업능력개발 훈련으로서 다음 각 목의 직업능력개발 훈련의 지원금
- 가. 제52조제1항제13호의 현장 훈련 지원 사업으로 실시하는 현장 훈련(훈련 기간이 6개월 이상인 경우로 한정한다)
- 나. 「국민 평생 직업능력 개발법 시행령」 제3조제1항제1호의 양성훈련으로 실시하는 직업능력개발 훈련
2. 제41조제1항제3호 및 제4호에 따른 직업능력개발 훈련의 지원금
3. 제41조제1항제5호가목 및 나목에 따른 직업능력개발 훈련의 지원금 중 다음 각 목의 어느 하나에 해당하는 지원금
- 가. 제41조제2항에 따라 지원되는 유급휴가기간 중에 지급한 임금 및 대체인력에게 지급한 임금의 일부에 해당하는 금액
- 나. 직업능력개발 훈련의 분야 및 기간 등을 고려하여 고용노동부장관이 고시하는 직업능력개발 훈련의 훈련비
4. 「산업현장 일학습병행 지원에 관한 법률」 제15조제2항에 따라 인정받은 일학습병행과정 훈련
Support funds falling under any of the following subparagraphs shall not be included in the limit of vocational skills development training expenses that the employer may receive support for under paragraphs ① through ③. <Amended on Dec. 24, 2013, Jul. 19, 2016, Jul. 3, 2018, Sep. 29, 2020, Jun. 8, 2021, Dec. 31, 2021, Feb. 17, 2022> 1. Support funds for vocational skills development training under Article 41 (1) 1, specifically vocational skills development training under the following sub-items: a. On-the-job training conducted as an on-the-job training support project under Article 52 (1) 13 (limited to cases where the training period is 6 months or longer) b. Vocational skills development training conducted as training for career advancement under Article 3 (1) 1 of the Enforcement Decree of the Lifelong Vocational Skills Development Promotion Act 2. Support funds for vocational skills development training under Article 41 (1) 3 and 4. 3. Among the support funds for vocational skills development training under Article 41 (1) 5 a and b, support funds falling under any of the following sub-items: a. An amount equivalent to part of the wages paid during the paid leave period and wages paid to substitute workers, supported under Article 41 (2). b. Training expenses for vocational skills development training announced by the Minister of Employment and Labor, considering the field and duration of the vocational skills development training. 4. Training for work-learning parallel courses recognized under Article 15 (2) of the Act on Support for Industrial On-the-Job Training and Work-Learning.
제2항부터 제4항까지의 규정에도 불구하고, 법 제35조제4항에 따라 직업능력개발 사업의 지원이 제한되는 사업주에 대해서는 「국민 평생 직업능력 개발법」 제55조제2항에 따른 지원 또는 융자 제한 기간의 종료일이 속한 보험연도부터 3년간 제2항부터 제4항까지의 규정을 적용하지 않는다. <신설 2015.6.30, 2020.8.27, 2022.2.17>
Notwithstanding paragraphs ② through ④, for employers whose support for vocational skills development projects is restricted under Article 35 (4) of the Act, paragraphs ② through ④ shall not apply for three years from the insurance year in which the period of restriction on support or loans under Article 55 (2) of the Lifelong Vocational Skills Development Promotion Act ends. <Newly added on Jun. 30, 2015, Aug. 27, 2020, Feb. 17, 2022>
