청장ㆍ사무소장 또는 출장소장은 법 제37조의2제2항에 따라 다음 각 호의 구분에 따른 시기에 외국인등록사항을 말소할 수 있다. <개정 2018.5.8>

1. 법 제37조제1항 본문에 따라 외국인등록증을 반납한 경우: 외국인등록증을 반납받은 때
2. 등록외국인이 국민이 된 경우: 등록외국인의 대한민국 국적 취득 사실을 확인한 때
3. 등록외국인이 사망한 경우: 진단서 또는 검안서 등을 통하여 등록외국인의 사망 사실을 확인한 때
4. 법 제31조제1항 각 호의 어느 하나에 해당하게 된 경우: 외교(A-1)ㆍ공무(A-2)ㆍ협정(A-3) 체류자격 등 해당 체류자격으로 체류자격 변경허가를 받은 사실을 확인한 때
5. 등록외국인이 출국 후 재입국허가기간(재입국허가를 면제받은 경우에는 면제받은 기간 또는 체류허가기간) 내에 입국하지 아니한 경우: 재입국허가기간(면제받은 기간 또는 체류허가기간)이 지난 때
6. 그 밖에 등록외국인이 법무부령으로 정하는 말소 사유에 해당하는 경우: 그 사유를 확인한 때

The head of a police station, immigration office, or branch office may cancel alien registration details at the time corresponding to each of the following subparagraphs, pursuant to Article 37-2(2) of this Act. <Amended on May 8, 2018> 1. In cases where the alien registration card has been returned pursuant to the main clause of Article 37(1) of this Act: When the alien registration card is received back 2. In cases where a registered alien becomes a national of the Republic of Korea: When the fact that a registered alien has acquired nationality of the Republic of Korea is confirmed 3. In cases where a registered alien has died: When the fact that a registered alien has died is confirmed through a medical certificate, autopsy report, etc. 4. In cases where the registered alien falls under any of the subparagraphs of Article 31(1) of this Act: When the fact that the alien has obtained permission to change status of stay to diplomatic (A-1), official (A-2), or treaty (A-3) status of stay is confirmed 5. In cases where a registered alien has not entered the Republic of Korea within the re-entry permit period (or the exempted period or the period of stay if re-entry is exempted) after departure: When the re-entry permit period (or the exempted period or the period of stay) has expired 6. In other cases where a registered alien falls under a reason for cancellation prescribed by the Ministry of Justice Ordinance: When such reason is confirmed

청장ㆍ사무소장 또는 출장소장은 외국인등록사항을 말소할 때에는 해당 등록외국인대장에 말소의 뜻을 표시하고 말소 사유와 연월일 및 담당 공무원의 성명을 적어야 한다. <개정 2018.5.8>

When the head of a police station, immigration office, or branch office cancels alien registration details, they shall indicate the cancellation on the registered alien's ledger and record the reason for cancellation, the date, and the name of the public official in charge. <Amended on May 8, 2018>

청장ㆍ사무소장 또는 출장소장은 제2항에 따라 외국인등록사항을 말소하였을 때에는 등록외국인 말소대장을 작성하여 따로 관리하여야 한다. <개정 2018.5.8>

When the head of a police station, immigration office, or branch office cancels alien registration details pursuant to paragraph ②, they shall compile and separately manage a ledger of canceled registered aliens. <Amended on May 8, 2018>

청장ㆍ사무소장 또는 출장소장은 제2항에 따라 외국인등록사항이 말소된 외국인이 법 제31조에 따라 새로 외국인등록을 하는 경우에는 말소되기 전에 해당 외국인에게 부여하였던 외국인등록번호와 같은 외국인등록번호를 부여한다. <개정 2018.5.8>

When a foreign national whose alien registration details have been canceled pursuant to paragraph ② newly registers as an alien pursuant to Article 31 of this Act, the head of a police station, immigration office, or branch office shall assign the same alien registration number as the one previously assigned to the alien before the cancellation. <Amended on May 8, 2018>

제1항부터 제4항까지에서 규정한 사항 외에 외국인등록사항의 말소 절차에 관하여 필요한 사항은 법무부장관이 정한다.

Matters necessary for the procedures for cancellation of alien registration details, other than those prescribed in paragraphs ① through ④, shall be determined by the Minister of Justice.
