청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 법 제65조제1항에 따라 직권으로 보호를 일시해제하려는 경우에는 피보호자, 피보호자의 보증인 또는 법정대리인등에게 보증금 납부능력을 소명하는 자료 등 보호의 일시해제 심사에 필요한 자료를 요청할 수 있다.

If the head of the Immigration Office, the head of the Immigration Branch Office, or the head of the Refugee Center intends to provisionally release protection by official initiative pursuant to Article 65 (1) of the Act, they may request the person under protection, their guarantor, or their legal representative to provide data necessary for the review of provisional release of protection, such as data proving their ability to pay the guarantee deposit.

청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 직권으로 보호를 일시해제하기로 결정한 때에는 다음 각 호의 사항을 적은 보호 일시해제 결정서를 작성하여 피보호자(부득이한 사유로 피보호자에게 보호 일시해제 결정서를 내줄 수 없는 경우에는 피보호자의 보증인 또는 법정대리인등을 말한다)에게 내주어야 한다.

2. 보호 일시해제 기간
3. 보증금의 액수ㆍ납부일시 및 장소
4. 법 제65조제1항에 따른 보호의 일시해제 조건
5. 보호의 일시해제 조건을 위반하면 보호의 일시해제를 취소하고 보증금을 국고에 귀속시킬 수 있다는 뜻

When the head of the Immigration Office, the head of the Immigration Branch Office, or the head of the Refugee Center decides to provisionally release protection by official initiative, they shall prepare a decision on provisional release of protection stating the following matters and deliver it to the person under protection (if it is impossible to deliver the decision on provisional release of protection to the person under protection due to unavoidable circumstances, it means the guarantor or legal representative of the person under protection). 1. Order, reasons, and applicable legal provisions 2. Period of provisional release of protection 3. Amount, payment deadline, and place of the guarantee deposit 4. Conditions for provisional release of protection pursuant to Article 65 (1) of the Act 5. That the provisional release of protection may be revoked and the guarantee deposit may be forfeited to the national treasury if the conditions for provisional release of protection are violated.

청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 직권으로 보호를 일시해제하기로 결정한 때에는 해당 피보호자를 보호하고 있는 보호시설의 장에게 보호 일시해제 기간이 포함된 보호해제 의뢰서를 보내야 한다.

When the head of the Immigration Office, the head of the Immigration Branch Office, or the head of the Refugee Center decides to provisionally release protection by official initiative, they shall send a request for release of protection, including the period of provisional release of protection, to the head of the protective facility where the person under protection is being held.

법 제65조제1항에 따른 보호 일시해제 시 보증금 예치 등의 절차에 관하여는 제17조제2항을 준용한다.

The procedures for depositing a guarantee deposit, etc. at the time of provisional release of protection pursuant to Article 65 (1) of the Act shall be applied mutatis mutandis to Article 17 (2).

법 제65조제1항에 따라 예치된 보증금은 법 제66조제2항에 따라 국고로 귀속되는 경우를 제외하고는 그 외국인이 출국하거나 보호의 일시해제를 취소하는 때에 보증금을 낸 사람에게 반환해야 한다.

Except for cases where the guarantee deposit is forfeited to the national treasury pursuant to Article 66 (2) of the Act, the deposited guarantee deposit shall be returned to the person who paid the guarantee deposit when the foreign national departs the country or when the provisional release of protection is revoked.
