청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 법 제65조제1항에 따라 직권으로 보호를 일시해제하려는 경우에는 피보호자, 피보호자의 보증인 또는 법정대리인등에게 보증금 납부능력을 소명하는 자료 등 보호의 일시해제 심사에 필요한 자료를 요청할 수 있다.

The Head of the Immigration Office, the head of an office, the head of a branch office, or the head of a protection facility, when intending to temporarily lift protection by authority pursuant to Article 65 (1) of the Act, may request the person under protection, the guarantor of the person under protection, or the legal representative, etc., to submit materials necessary for the review of temporary lifting of protection, such as materials proving the ability to pay the security deposit.

청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 직권으로 보호를 일시해제하기로 결정한 때에는 다음 각 호의 사항을 적은 보호 일시해제 결정서를 작성하여 피보호자(부득이한 사유로 피보호자에게 보호 일시해제 결정서를 내줄 수 없는 경우에는 피보호자의 보증인 또는 법정대리인등을 말한다)에게 내주어야 한다.

3. 보증금의 액수ㆍ납부일시 및 장소
4. 법 제65조제1항에 따른 보호의 일시해제 조건

청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 직권으로 보호를 일시해제하기로 결정한 때에는 해당 피보호자를 보호하고 있는 보호시설의 장에게 보호 일시해제 기간이 포함된 보호해제 의뢰서를 보내야 한다.

When the Head of the Immigration Office, the head of an office, the head of a branch office, or the head of a protection facility decides to temporarily lift protection by authority, they shall send a request for the lifting of protection, including the period of temporary lifting of protection, to the head of the protection facility where the relevant person under protection is being protected.

법 제65조제1항에 따른 보호 일시해제 시 보증금 예치 등의 절차에 관하여는 제17조제2항을 준용한다.

법 제65조제1항에 따라 예치된 보증금은 법 제66조제2항에 따라 국고로 귀속되는 경우를 제외하고는 그 외국인이 출국하거나 보호의 일시해제를 취소하는 때에 보증금을 낸 사람에게 반환해야 한다.

The security deposit deposited pursuant to Article 65 (1) of the Act shall be returned to the person who paid the security deposit when the foreigner departs from the country or when the temporary lifting of protection is revoked, except in cases where the security deposit is confiscated to the national treasury pursuant to Article 66 (2) of the Act.
