영 제23조제3항제1호의 "단순노무행위"라 함은 단순하고 일상적인 육체노동을 요하는 업무로서 한국표준직업분류(통계청고시)에 의한 단순노무직 근로자의 취업분야를 말한다.
The term "simple labor activity" as used in Article 23 (3) (1) of the Enforcement Decree refers to work requiring simple and routine physical labor, specifically the employment fields of workers in simple labor occupations according to the Korean Standard Occupational Classification (Notified by Statistics Korea).
영 제23조제3항제2호의 "선량한 풍속이나 그 밖의 사회질서에 반하는 행위"라 함은 다음 각 호의 어느 하나에 해당하는 행위를 말한다. <개정 2002.4.27, 2005.7.8, 2010.11.16, 2013.5.31, 2023.12.14>
1. 「사행행위 등 규제 및 처벌특례법」 제2조제1항제1호 및 동법 시행령 제1조의2등에서 규정하고 있는 사행행위 영업장소등에 취업하는 행위
2. 「식품위생법」 제36조제3항 및 같은 법 시행령 제21조제8호 등에서 규정하고 있는 유흥주점등에서 유흥종사자로 근무하는 행위
3. 「풍속영업의 규제에 관한 법률」 제2조 및 동법 시행령 제2조등에서 규정하고 있는 풍속영업중 선량한 풍속에 반하는 영업장소등에 취업하는 행위
The term "act contrary to good morals or other social order" as used in Article 23 (3) (2) of the Enforcement Decree refers to acts falling under any of the following subparagraphs. <Amended on Apr. 27, 2002, Jul. 8, 2005, Nov. 16, 2010, May 31, 2013, Dec. 14, 2023> 1. Engaging in employment at gambling establishments, etc., as defined in Article 2 (1) (1) of the Act on Special Cases Concerning the Regulation and Punishment of Speculative Acts and the like and Article 1-2 of its Enforcement Decree. 2. Working as an entertainer in entertainment bars, etc., as prescribed by Article 36 (3) of the 「Food Sanitation Act」 and Article 21 (8) of its Enforcement Decree. 3. Engaging in employment at gambling establishments, etc., which are contrary to good morals among businesses regulated by the 「Act on the Regulation of Prostitution-Related Businesses」 and its Enforcement Decree, as defined in Article 2 of the Act and Article 2 of its Enforcement Decree.
법무부장관은 제1항 및 제2항과 영 제23조제3항제3호에 따른 재외동포의 취업활동 제한에 관한 구체적 범위를 지정하여 고시한다. <개정 2009.4.3>
The Minister of Justice shall designate and notify the specific scope of restrictions on employment activities of overseas Koreans pursuant to paragraphs (1) and (2) and Article 23 (3) (3) of the Enforcement Decree. <Amended on Apr. 3, 2009>
