Article 27-2 (Restrictions on Employment Activities of Overseas Koreans)
제27조의2 재외동포의 취업활동 제한

영 제23조제3항제1호의 "단순노무행위"라 함은 단순하고 일상적인 육체노동을 요하는 업무로서 한국표준직업분류(통계청고시)에 의한 단순노무직 근로자의 취업분야를 말한다.
"Manual labor activities" referred to in Article 23, Paragraph 3, Subparagraph 1 of the Enforcement Decree shall mean work requiring simple and routine physical labor, referring to the employment fields of manual laborers according to the Korean Standard Occupational Classification (Notification by Statistics Korea).
영 제23조제3항제2호의 "선량한 풍속이나 그 밖의 사회질서에 반하는 행위"라 함은 다음 각 호의 어느 하나에 해당하는 행위를 말한다. <개정 2002.4.27, 2005.7.8, 2010.11.16, 2013.5.31, 2023.12.14>
1. 「사행행위 등 규제 및 처벌특례법」 제2조제1항제1호 및 동법 시행령 제1조의2등에서 규정하고 있는 사행행위 영업장소등에 취업하는 행위
2. 「식품위생법」 제36조제3항 및 같은 법 시행령 제21조제8호 등에서 규정하고 있는 유흥주점등에서 유흥종사자로 근무하는 행위
3. 「풍속영업의 규제에 관한 법률」 제2조 및 동법 시행령 제2조등에서 규정하고 있는 풍속영업중 선량한 풍속에 반하는 영업장소등에 취업하는 행위
"Acts contrary to good morals or other social order" referred to in Article 23, Paragraph 3, Subparagraph 2 of the Enforcement Decree shall mean any of the following acts. <Amended on Apr. 27, 2002, Jul. 8, 2005, Nov. 16, 2010, May. 31, 2013, Dec. 14, 2023> 1. Engaging in employment at a gambling business establishment, etc. as prescribed in Article 2, Paragraph 1, Subparagraph 1 of the Act on Special Cases Concerning the Regulation and Punishment of Gambling Activities and Article 1-2 of the Presidential Decree of the same Act. 2. Working as an entertainer in a entertainment bar, etc. as prescribed in Article 36, Paragraph 3 of the Food Sanitation Act and Article 21, Paragraph 8 of the Presidential Decree of the same Act. 3. Engaging in employment at a business establishment, etc. that is contrary to good morals among regulated businesses related to morals as prescribed in Article 2 of the Act on the Regulation of Morality-Related Businesses and Article 2 of the Presidential Decree of the same Act.
법무부장관은 제1항 및 제2항과 영 제23조제3항제3호에 따른 재외동포의 취업활동 제한에 관한 구체적 범위를 지정하여 고시한다. <개정 2009.4.3>
The Minister of Justice shall designate and notify the specific scope of restrictions on the employment activities of overseas Koreans pursuant to Paragraphs 1 and 2, and Article 23, Paragraph 3, Subparagraph 3 of the Enforcement Decree. <Amended on Apr. 3, 2009>
