Article 51 (Order of Appropriation of Overpaid Amounts)

제51조 과오납금의 충당 순서

공단은 법 제86조제1항에 따라 같은 항에 따른 과오납금(이하 "과오납금"이라 한다)을 다음 각 호의 구분에 따라 각 목의 순서대로 충당해야 한다. <개정 2016.9.22, 2020.6.2>

  1. 1. 보험료와 그에 따른 연체금을 과오납부(過誤納付)한 경우

    1. 가. 체납처분비
    2. 나. 체납된 보험료와 그에 따른 연체금
    3. 다. 앞으로 내야 할 1개월분의 보험료(납부의무자가 동의한 경우만 해당한다)

  2. 2. 법 제57조에 따른 징수금(이하 이 호에서 "징수금"이라 한다)과 그에 따른 연체금을 과오납부한 경우

    1. 가. 체납처분비
    2. 나. 체납된 징수금과 그에 따른 연체금

  3. 3. 가산금과 그에 따른 연체금을 과오납부한 경우

    1. 가. 체납처분비
    2. 나. 체납된 가산금과 그에 따른 연체금

The Corporation shall appropriate overpaid amounts (hereinafter referred to as "overpaid amounts") pursuant to Article 86 (1) of the Act in the order of the sub-items of each of the following items. 1. In the case of overpayment of insurance premiums and their accrued late charges: a. Costs of collection of arrears b. Arrears of insurance premiums and their accrued late charges c. Insurance premiums for one month that are yet to be paid (only when the obligor consents) 2. In the case of overpayment of collected amounts pursuant to Article 57 of the Act (hereinafter referred to as "collected amounts" in this subparagraph) and their accrued late charges: a. Costs of collection of arrears b. Arrears of collected amounts and their accrued late charges 3. In the case of overpayment of additional charges and their accrued late charges: a. Costs of collection of arrears b. Arrears of additional charges and their accrued late charges

공단은 제1항제1호부터 제3호까지의 규정에 따라 충당한 후 남은 금액이 있는 경우에는 다음 각 호의 구분에 따라 충당할 수 있다. <개정 2016.9.22>

  1. 1. 제1항제1호에 따라 충당하고 남은 금액이 있는 경우: 같은 항 제2호 각 목의 순서에 따라 충당하고, 그 다음에 같은 항 제3호 각 목의 순서에 따라 충당할 것

  2. 2. 제1항제2호에 따라 충당하고 남은 금액이 있는 경우: 같은 항 제1호 각 목의 순서에 따라 충당하고, 그 다음에 같은 항 제3호 각 목의 순서에 따라 충당할 것

  3. 3. 제1항제3호에 따라 충당하고 남은 금액이 있는 경우: 같은 항 제1호 각 목의 순서에 따라 충당하고, 그 다음에 같은 항 제2호 각 목의 순서에 따라 충당할 것

If there is a remaining amount after appropriation pursuant to subparagraphs 1 through 3 of paragraph ①, the Corporation may appropriate it in the order of the following subparagraphs. 1. If there is a remaining amount after appropriation pursuant to subparagraph 1 of paragraph ①: Appropriated in the order of the sub-items of subparagraph 2 of the same paragraph, and then in the order of the sub-items of subparagraph 3 of the same paragraph. 2. If there is a remaining amount after appropriation pursuant to subparagraph 2 of paragraph ①: Appropriated in the order of the sub-items of subparagraph 1 of the same paragraph, and then in the order of the sub-items of subparagraph 3 of the same paragraph. 3. If there is a remaining amount after appropriation pursuant to subparagraph 3 of paragraph ①: Appropriated in the order of the sub-items of subparagraph 1 of the same paragraph, and then in the order of the sub-items of subparagraph 2 of the same paragraph.
