공단은 국가, 지방자치단체, 요양기관, 「보험업법」에 따른 보험회사 및 보험료율 산출 기관, 「공공기관의 운영에 관한 법률」에 따른 공공기관, 그 밖의 공공단체 등에 대하여 다음 각 호의 업무를 수행하기 위하여 주민등록ㆍ가족관계등록ㆍ국세ㆍ지방세ㆍ토지ㆍ건물ㆍ출입국관리 등의 자료로서 대통령령으로 정하는 자료를 제공하도록 요청할 수 있다. <개정 2014.5.20>
1. 가입자 및 피부양자의 자격 관리, 보험료의 부과ㆍ징수, 보험급여의 관리 등 건강보험사업의 수행
2. 제14조제1항제11호에 따른 업무의 수행
The Corporation may request the provision of data, as prescribed by Presidential Decree, such as resident registration, family relationship registration, national taxes, local taxes, land, buildings, immigration control, etc., from the State, local governments, medical institutions, insurance companies and premium rate calculation institutions under the Insurance Business Act, public institutions under the Act on the Management of Public Institutions, and other public organizations, in order to perform the following tasks: <Amended by May 20, 2014> 1. Performance of health insurance business, including qualification management of subscribers and dependents, imposition and collection of insurance premiums, and management of insurance benefits 2. Performance of tasks under Article 14 (1) 11.
심사평가원은 국가, 지방자치단체, 요양기관, 「보험업법」에 따른 보험회사 및 보험료율 산출 기관, 「공공기관의 운영에 관한 법률」에 따른 공공기관, 그 밖의 공공단체 등에 대하여 요양급여비용을 심사하고 요양급여의 적정성을 평가하기 위하여 주민등록ㆍ출입국관리ㆍ진료기록ㆍ의약품공급 등의 자료로서 대통령령으로 정하는 자료를 제공하도록 요청할 수 있다. <개정 2014.5.20>
The Health Insurance Review and Assessment Service may request the provision of data, as prescribed by Presidential Decree, such as resident registration, immigration control, medical records, and drug supply, from the State, local governments, medical institutions, insurance companies and premium rate calculation institutions under the Insurance Business Act, public institutions under the Act on the Management of Public Institutions, and other public organizations, in order to review medical care benefit costs and evaluate the appropriateness of medical care benefits. <Amended by May 20, 2014>
보건복지부장관은 관계 행정기관의 장에게 제41조의2에 따른 약제에 대한 요양급여비용 상한금액의 감액 및 요양급여의 적용 정지를 위하여 필요한 자료를 제공하도록 요청할 수 있다. <신설 2018.3.27>
The Minister of Health and Welfare may request the heads of related administrative agencies to provide data necessary for the reduction of the upper limit of medical care benefit costs for drugs under Article 41-2 and the suspension of the application of medical care benefits. <Newly established by March 27, 2018>
제1항부터 제3항까지의 규정에 따라 자료 제공을 요청받은 자는 성실히 이에 따라야 한다. <개정 2018.3.27>
Those who are requested to provide data under paragraphs (1) through (3) shall faithfully comply with such requests. <Amended by March 27, 2018>
공단 또는 심사평가원은 요양기관, 「보험업법」에 따른 보험회사 및 보험료율 산출 기관에 제1항 또는 제2항에 따른 자료의 제공을 요청하는 경우 자료 제공 요청 근거 및 사유, 자료 제공 대상자, 대상기간, 자료 제공 기한, 제출 자료 등이 기재된 자료제공요청서를 발송하여야 한다. <신설 2016.3.22, 2018.3.27>
When the Corporation or the Health Insurance Review and Assessment Service requests the provision of data under paragraph (1) or (2) from medical institutions, insurance companies and premium rate calculation institutions under the Insurance Business Act, they shall send a data provision request form stating the grounds and reasons for the data provision request, the data recipients, the target period, the data provision deadline, and the submitted data. <Newly established by March 22, 2016, Amended by March 27, 2018>
제1항 및 제2항에 따른 국가, 지방자치단체, 요양기관, 「보험업법」에 따른 보험료율 산출 기관 그 밖의 공공기관 및 공공단체가 공단 또는 심사평가원에 제공하는 자료에 대하여는 사용료와 수수료 등을 면제한다. <개정 2016.3.22, 2018.3.27>
Fees and charges for data provided by the State, local governments, medical institutions, premium rate calculation institutions under the Insurance Business Act, other public institutions, and public organizations to the Corporation or the Health Insurance Review and Assessment Service under paragraphs (1) and (2) shall be exempted. <Amended by March 22, 2016, Amended by March 27, 2018>
