개인정보처리자가 개인정보를 처리할 때 개인정보에 관한 권리 또는 이익을 침해받은 사람은 보호위원회에 그 침해 사실을 신고할 수 있다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2020.2.4>
A person whose rights or interests regarding personal information are infringed while processing personal information may report the fact of infringement to the Protection Committee. <Amended on March 23, 2013, November 19, 2014, July 26, 2017, February 4, 2020>
보호위원회는 제1항에 따른 신고의 접수ㆍ처리 등에 관한 업무를 효율적으로 수행하기 위하여 대통령령으로 정하는 바에 따라 전문기관을 지정할 수 있다. 이 경우 전문기관은 개인정보침해 신고센터(이하 "신고센터"라 한다)를 설치ㆍ운영하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2020.2.4>
The Protection Committee may designate a specialized agency, as prescribed by Presidential Decree, for the efficient performance of tasks related to the receipt and processing of reports under Paragraph ①. In this case, the specialized agency shall establish and operate a personal information infringement reporting center (hereinafter referred to as the "Reporting Center"). <Amended on March 23, 2013, November 19, 2014, July 26, 2017, February 4, 2020>
신고센터는 다음 각 호의 업무를 수행한다.
1. 개인정보 처리와 관련한 신고의 접수ㆍ상담
2. 사실의 조사ㆍ확인 및 관계자의 의견 청취
3. 제1호 및 제2호에 따른 업무에 딸린 업무
The Reporting Center shall perform the following tasks: 1. Receipt and consultation of reports related to personal information processing 2. Investigation and verification of facts, and hearing the opinions of related parties 3. Tasks incidental to the tasks under subparagraphs 1 and 2
보호위원회는 제3항제2호의 사실 조사ㆍ확인 등의 업무를 효율적으로 하기 위하여 필요하면 「국가공무원법」 제32조의4에 따라 소속 공무원을 제2항에 따른 전문기관에 파견할 수 있다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2020.2.4>
If necessary for the efficient performance of tasks such as fact investigation and verification under Paragraph ③, subparagraph 2, the Protection Committee may dispatch its public officials to the specialized agency under Paragraph ② in accordance with Article 32-4 of the State Public Officials Act. <Amended on March 23, 2013, November 19, 2014, July 26, 2017, February 4, 2020>
