제84조 운전면허시험의 면제

①

다음 각 호의 어느 하나에 해당하는 사람에 대하여는 대통령령으로 정하는 바에 따라 운전면허시험의 일부를 면제한다. <개정 2012.2.10, 2016.12.2, 2020.6.9, 2021.1.12>

  1. 1. 대학ㆍ전문대학 또는 공업계 고등학교의 기계과나 자동차와 관련된 학과를 졸업한 사람으로서 재학 중 자동차에 관한 과목을 이수한 사람

  2. 2. 「국가기술자격법」 제10조에 따라 자동차의 정비 또는 검사에 관한 기술자격시험에 합격한 사람

  3. 3. 외국의 권한 있는 기관에서 발급한 운전면허증(이하 "외국면허증"이라 한다)을 가진 사람 가운데 다음 각 목의 어느 하나에 해당되는 사람

    1. 가. 「주민등록법」 제6조에 따라 주민등록이 된 사람
    2. 나. 「출입국관리법」 제31조에 따라 외국인등록을 한 사람(이하 "등록외국인"이라 한다) 또는 외국인등록이 면제된 사람
    3. 다. 「난민법」에 따른 난민인정자
    4. 라. 「재외동포의 출입국과 법적 지위에 관한 법률」 제6조에 따라 국내거소신고를 한 사람(이하 "외국국적동포"라 한다)

  4. 4. 군(軍) 복무 중 자동차등에 상응하는 군 소속 차를 6개월 이상 운전한 경험이 있는 사람

  5. 5. 제87조제2항 또는 제88조에 따른 적성검사를 받지 아니하여 운전면허가 취소된 후 다시 면허를 받으려는 사람

  6. 6. 운전면허를 받은 후 제80조제2항의 구분에 따라 운전할 수 있는 자동차의 종류를 추가하려는 사람

  7. 7. 제93조제1항제15호부터 제18호까지의 규정에 따라 운전면허가 취소된 후 다시 운전면허를 받으려는 사람

  8. 8. 제108조제5항에 따른 자동차운전 전문학원의 수료증 또는 졸업증을 소지한 사람

  9. 9. 군사분계선 이북지역에서 운전면허를 받은 사실이 인정되는 사람

For persons falling under any of the following subparagraphs, a part of the driver's license test shall be exempted according to Presidential Decree. <Amended by 2012.2.10, 2016.12.2, 2020.6.9, 2021.1.12> 1. A person who has graduated from the mechanical engineering department or a department related to automobiles at a university, junior college, or vocational high school, and has completed subjects related to automobiles during their studies. 2. A person who has passed a technical qualification test for automobile maintenance or inspection pursuant to Article 10 of the "National Technical Qualification Act." 3. A person who holds a driver's license issued by a competent authority of a foreign country (hereinafter referred to as "foreign license") and falls under any of the following: a. A person who is registered as a resident according to Article 6 of the "Resident Registration Act." b. A person who is registered as a foreigner according to Article 31 of the "Immigration Act" (hereinafter referred to as "registered foreigner") or a person exempted from foreigner registration. c. A person recognized as a refugee under the "Refugee Act." d. A person who has reported their place of residence in Korea according to Article 6 of the "Act on the Immigration and Legal Status of Overseas Koreans" (hereinafter referred to as "overseas Korean national of foreign nationality"). 4. A person who has experience driving a military vehicle equivalent to a motor vehicle for at least six months while serving in the military. 5. A person who intends to obtain a driver's license again after their driver's license was revoked for failing to undergo the aptitude test pursuant to Article 87 (2) or Article 88. 6. A person who intends to add a type of vehicle they can drive, according to the classification in Article 80 (2), after obtaining a driver's license. 7. A person who intends to obtain a driver's license again after their driver's license was revoked pursuant to subparagraphs 15 through 18 of Article 93 (1). 8. A person who holds a completion certificate or diploma from a professional driving academy established under Article 108 (5). 9. A person who is recognized to have obtained a driver's license in the area north of the Military Demarcation Line.

제1항제3호에 따른 외국면허증(그 운전면허증을 발급한 국가에서 90일을 초과하여 체류하면서 그 체류기간 동안 취득한 것으로서 임시면허증 또는 연습면허증이 아닌 것을 말한다)을 가진 사람에 대하여는 해당 국가가 대한민국 운전면허증을 가진 사람에게 적성시험을 제외한 모든 운전면허시험 과정을 면제하는 국가(이하 이 조에서 "국내면허 인정국가"라 한다)인지 여부에 따라 대통령령으로 정하는 바에 따라 면제하는 운전면허시험을 다르게 정할 수 있다. 다만, 외교, 공무(公務) 또는 연구 등 대통령령으로 정하는 목적으로 국내에 체류하고 있는 사람이 가지고 있는 외국면허증은 국내면허 인정국가의 권한 있는 기관에서 발급한 운전면허증으로 보며, 국내면허 인정국가 가운데 우리나라와 운전면허의 상호인정에 관한 약정을 체결한 국가에 대하여는 그 약정한 내용에 따라 운전면허시험의 일부를 면제할 수 있다.

For a person who holds a foreign license under subparagraph 3 of paragraph ① (excluding temporary licenses or learner's permits obtained while staying in the issuing country for more than 90 days and during that period), the driver's license test to be exempted may be determined differently according to Presidential Decree, depending on whether that country exempts all driver's license test processes except for the aptitude test for holders of a Korean driver's license (hereinafter referred to as "country recognizing domestic license" in this Article). However, a foreign license held by a person staying in Korea for purposes such as diplomacy, public service, or research as prescribed by Presidential Decree shall be regarded as a driver's license issued by a competent authority of a country recognizing domestic licenses, and for countries recognizing domestic licenses that have concluded an agreement on mutual recognition of driver's licenses with Korea, a part of the driver's license test may be exempted according to the terms of the agreement.

한국도로교통공단은 제1항제3호 및 제2항에 따라 외국면허증을 가진 사람에게 운전면허시험의 일부를 면제하고 국내운전면허증을 발급하는 경우에는 해당 외국면허증을 발급한 국가의 요청이 있는 경우 등 대통령령으로 정하는 사유가 있는 경우에만 그 사람의 외국면허증을 회수할 수 있다. 이 경우 그 외국면허증을 발급한 국가의 관계 기관의 요청이 있는 경우에는 그 외국면허증을 해당 국가에 송부할 수 있다. <개정 2021.10.19, 2024.1.30>

The Korea Road Traffic Authority may collect the foreign license from a person who has been granted a partial exemption from the driver's license test and issued a domestic driver's license under subparagraph 3 of paragraph ① and paragraph ②, only under circumstances prescribed by Presidential Decree, such as upon request from the country that issued the foreign license. In this case, if requested by the relevant authorities of the country that issued the foreign license, it may be sent to that country. <Amended by 2021.10.19, 2024.1.30>
