①

법 제77조의2제1항에서 "「예술인 복지법」 제2조제2호에 따른 예술인 등 대통령령으로 정하는 사람"이란 다음 각 호의 어느 하나에 해당하는 사람을 말한다. <개정 2023.9.12, 2023.12.26>

1. 「예술인 복지법」 제2조제2호의2에 따른 예술 활동 증명 예술인
2. 「예술인 복지법」 제3조의2제1항 각 호의 어느 하나에 해당하나 예술 활동 증명을 받지 못하였거나 예술 활동 증명의 유효기간이 지난 사람으로서 문화예술 분야에서 창작, 실연(實演), 기술지원 등의 활동을 하고 있거나 하려는 사람

Persons who fall under any of the subparagraphs of Article 3-2, Paragraph 1 of the 「Act on the Welfare of Artists」 but have not obtained certification of artistic activities or whose certification of artistic activities has expired, and who are engaged or intend to engage in activities such as creation, performance, or technical support in the cultural and arts field.

1. 예술인과 사업주가 체결한 문화예술용역 관련 계약의 월평균소득(예술인이 문화예술용역 관련 계약에서 지급받기로 한 금액을 계약기간으로 나누어 월 단위로 산정한 금액을 말한다. 이하 같다)이 50만원 이상일 것
2. 제1호에 따른 소득 기준을 충족하지 못하는 예술인이 둘 이상의 문화예술용역 관련 계약을 체결한 경우로서 같은 기간에 해당하는 문화예술용역 관련 계약의 월평균소득을 합산(본인이 합산하기를 원하는 경우만 해당한다)하여 그 합계액이 50만원 이상일 것

The "income criteria prescribed by Presidential Decree" in Article 77-2, Paragraph 2, Item 2 of the Act refers to the following subparagraphs. <Amended by Presidential Decree No. 34071, Jun. 27, 2023> 1. The monthly average income from contracts related to cultural and arts services concluded between an artist and an employer (meaning the amount calculated on a monthly basis by dividing the amount an artist is to receive from a contract related to cultural and arts services by the contract period; hereinafter the same shall apply) shall be 500,000 won or more. 2. In cases where an artist who does not meet the income criteria under Item 1 has concluded two or more contracts related to cultural and arts services, and the monthly average income from contracts related to cultural and arts services for the corresponding period is aggregated (only when the artist wishes to aggregate), the total amount shall be 500,000 won or more.

제2항제2호에 따라 예술인은 둘 이상의 문화예술용역 관련 계약의 월평균소득을 합산하기를 원하는 경우에는 고용노동부령으로 정하는 바에 따라 문화예술용역 관련 계약의 월평균소득의 합계액이 50만원 이상이 되는 날이 속하는 달의 다음 달 15일까지 고용노동부장관에게 합산 신청을 해야 한다.

When an artist wishes to aggregate the monthly average income from two or more contracts related to cultural and arts services pursuant to Item 2 of Paragraph 2, the artist shall apply for aggregation to the Minister of Employment and Labor by the 15th of the month following the month in which the date of the monthly average income from contracts related to cultural and arts services totaling 500,000 won or more falls, in accordance with the regulations prescribed by the Minister of Employment and Labor.

제3항에 따라 합산 신청을 받은 고용노동부장관은 해당 예술인이 제2항제2호에 따른 소득 기준을 충족하는지를 확인하여 그 결과를 해당 사업주(소득 기준을 충족하는 경우만 해당한다) 및 예술인에게 통보해야 한다. 이 경우 예술인이 제3항에 따라 합산 신청을 한 때에 해당 사업주가 제104조의6제1항에 따라 그 예술인의 피보험자격 취득에 관한 신고를 한 것으로 본다.

Upon receiving the aggregation application pursuant to Paragraph 3, the Minister of Employment and Labor shall verify whether the artist meets the income criteria under Item 2 of Paragraph 2 and notify the employer (only when the income criteria are met) and the artist of the results. In this case, when the artist submits the aggregation application pursuant to Paragraph 3, it shall be deemed that the employer has filed a report concerning the acquisition of insured status of the artist pursuant to Article 104-6, Paragraph 1.
