2. 피보험자인 근로자에게 「남녀고용평등과 일ㆍ가정 양립 지원에 관한 법률」 제19조에 따른 육아휴직 또는 같은 법 제19조의2에 따른 육아기 근로시간 단축(이하 "육아휴직등" 이라 한다)을 30일[「근로기준법」 제74조제1항에 따른 출산전후휴가(이하 "출산전후휴가"라 한다)의 기간과 중복되는 기간은 제외한다] 이상 허용한 우선지원대상기업의 사업주
3. 피보험자인 근로자에게 출산전후휴가, 「근로기준법」 제74조제3항에 따른 유산ㆍ사산 휴가(이하 "유산ㆍ사산 휴가"라 한다) 또는 육아휴직등을 30일 이상 부여하거나 허용하고 대체인력을 고용하거나 파견근로자를 대체인력으로 사용한 경우로서 다음 각 목의 요건을 모두 갖춘 우선지원대상기업의 사업주
- 가. 다음의 어느 하나에 해당할 것 1) 출산전후휴가, 유산ㆍ사산 휴가 또는 육아휴직등의 시작일 전 2개월이 되는 날(출산전후휴가에 연이어 유산ㆍ사산 휴가 또는 육아휴직등을 시작하는 경우에는 출산전후휴가 시작일 전 2개월이 되는 날) 이후 새로 대체인력을 고용하거나 파견근로자를 대체인력으로 사용하여 30일 이상 계속 고용하거나 사용한 경우 2) 피보험자인 근로자에게 임신 중에 60일을 초과하여 근로시간 단축을 허용하고 대체인력을 고용하거나 파견근로자를 대체인력으로 사용한 경우로서 그 근로자가 근로시간 단축 종료에 연이어 출산전후휴가, 유산ㆍ사산 휴가 또는 육아휴직등을 시작한 이후에도 같은 대체인력을 계속 고용하거나 사용한 경우. 이 경우 대체인력을 고용하거나 사용한 기간은 30일 이상이어야 한다.
- 나. 삭제 <2020.3.31>
- 다. 새로 대체인력을 고용하거나 파견근로자를 대체인력으로 사용하기 전 3개월부터 대체인력의 고용 또는 사용 후 1년까지(해당 대체인력의 고용기간 또는 사용기간이 1년 미만인 경우에는 그 고용관계 또는 사용관계 종료 시까지를 말한다) 고용조정으로 다른 근로자(새로 고용 또는 사용한 대체인력보다 나중에 고용된 근로자는 제외한다)를 이직시키지 않을 것
4. 다음 각 목의 어느 하나에 해당하는 우선지원대상기업의 사업주
- 가. 피보험자인 근로자에게 육아휴직등을 30일 이상 허용한 경우로서 해당 근로자의 업무 전부 또는 일부를 대신하여 수행할 근로자(이하 "업무분담자"라 한다)를 지정하고 해당 업무분담자에게 업무분담에 대한 금전적 지원을 한 우선지원대상기업의 사업주. 다만, 육아기 근로시간 단축 근로자에 대한 업무분담자를 지정한 경우에는 육아기 근로시간 단축 근로자의 단축된 근로시간이 주당 10시간 이상이어야 한다.
- 나. 피보험자인 근로자에게 「남녀고용평등과 일ㆍ가정 양립 지원에 관한 법률」 제18조의2에 따른 배우자 출산전후휴가(이하 "배우자 출산전후휴가"라 한다)를 20일간 연속으로 부여한 경우로서 그 기간 동안 계속하여 업무분담자를 지정하고 해당 업무분담자에게 업무분담에 대한 금전적 지원을 한 우선지원대상기업의 사업주

Employers of priority support target companies that have granted childcare leave under Article 19 of the 「Act on Equal Employment Opportunity and Support for Work-Family Reconciliation」 or reduced working hours during childcare leave under Article 19-2 of the same Act (hereinafter referred to as "childcare leave, etc.") to insured workers for 30 days or more (excluding periods overlapping with maternity leave under Article 74(1) of the 「Labor Standards Act」, hereinafter referred to as "maternity leave"). 3. Employers of priority support target companies that have granted or permitted maternity leave, miscarriage or stillbirth leave under Article 74(3) of the 「Labor Standards Act」 (hereinafter referred to as "miscarriage or stillbirth leave") or childcare leave, etc. for 30 days or more, and have employed or used dispatched workers as replacement personnel, and meet all of the following requirements: a. Falls under any of the following: 1) Employers that have newly employed replacement personnel or used dispatched workers as replacement personnel for 30 days or more continuously, within two months prior to the start date of maternity leave, miscarriage or stillbirth leave, or childcare leave, etc. (if starting miscarriage or stillbirth leave or childcare leave, etc. consecutively after maternity leave, within two months prior to the start date of maternity leave). 2) Employers that have allowed insured workers to reduce working hours for more than 60 days during pregnancy and have employed or used dispatched workers as replacement personnel, and have continued to employ or use the same replacement personnel after the worker begins maternity leave, miscarriage or stillbirth leave, or childcare leave, etc. consecutively after the end of working hour reduction. In this case, the period of employing or using replacement personnel shall be 30 days or more. b. Deleted <Mar. 31, 2020> c. Employers shall not dismiss other workers (excluding workers employed later than the newly employed or used replacement personnel) due to employment adjustment from three months prior to the new employment or use of replacement personnel until one year after the employment or use of replacement personnel (if the employment period or usage period of the replacement personnel is less than one year, until the termination of the employment relationship or usage relationship). 4. Employers of priority support target companies that fall under any of the following: a. Employers of priority support target companies that have designated workers to perform all or part of the duties of insured workers who have taken childcare leave, etc. for 30 days or more (hereinafter referred to as "work sharers") and have provided monetary support to these work sharers for work sharing. However, if a work sharer is designated for a worker with reduced working hours during childcare leave, the reduced working hours of the worker with reduced working hours during childcare leave must be 10 hours or more per week. b. Employers of priority support target companies that have granted consecutive paternity leave under Article 18-2 of the 「Act on Equal Employment Opportunity and Support for Work-Family Reconciliation」 (hereinafter referred to as "paternity leave") for 20 days, and have designated a work sharer continuously during that period and provided monetary support to the work sharer for work sharing.
고용노동부장관은 제1항에도 불구하고 다음 각 호에 해당하는 사업주에게는 출산육아기 고용안정장려금을 지급하지 않는다. <신설 2022.6.28, 2026.5.6>
1. 「부패방지 및 국민권익위원회의 설치와 운영에 관한 법률」 제2조제1호가목부터 다목까지에 해당하는 기관 및 「공공기관의 운영에 관한 법률」 제4조부터 제6조까지의 규정에 따라 지정ㆍ고시된 공공기관의 사업주
2. 임금 등을 체불하여 「근로기준법」 제43조의2에 따라 명단이 공개 중이거나 같은 법 제43조의4에 따라 상습체불사업주로 정해진 사업주
3. 그 밖에 법 제23조에 따른 지원 목적에 부합하지 않는다고 고용노동부장관이 정하여 고시하는 대상이나 업종의 사업주
The Minister of Employment and Labor shall not grant the Employment Stabilization Grant for Childbirth and Childcare Leave to employers who fall under any of the following criteria, notwithstanding paragraph ①. <Newly added by Act No. 18360, Jun. 28, 2022; Act No. 20751, May 6, 2026> 1. Employers of institutions falling under subparagraphs (a) through (c) of Article 2(1) of the 「Act on the Prevention of Corruption and the Establishment and Operation of the Anti-Corruption and Civil Rights Commission」 and public institutions designated and notified according to Articles 4 through 6 of the 「Act on the Management of Public Institutions」. 2. Employers whose names are publicly disclosed under Article 43-2 of the 「Labor Standards Act」 due to unpaid wages or other reasons, or who are designated as habitual wage defaulters under Article 43-4 of the same Act. 3. Employers in target areas or industries that the Minister of Employment and Labor deems to be inconsistent with the purpose of support under Article 23 of this Act and notifies accordingly.
제1항제2호에 따른 출산육아기 고용안정장려금은 육아휴직등의 허용에 따른 사업주의 노무비용부담, 육아휴직등의 대상 자녀의 나이 등을 고려하여 매년 고용노동부장관이 정하여 고시하는 금액에 근로자가 사용한 육아휴직등의 개월 수를 곱하여 산정한 금액으로 한다. <개정 2012.1.13, 2013.1.25, 2015.6.30, 2016.12.30, 2020.3.31, 2021.12.31, 2022.6.28>

제1항제3호에 따른 출산육아기 고용안정장려금(이하 "대체인력지원금"이라 한다. 이하 이 조에서 같다)은 대체인력의 고용 또는 사용에 따른 사업주의 노무비용부담을 고려하여 고용노동부장관이 정하여 고시하는 금액에 출산전후휴가, 유산ㆍ사산 휴가 또는 육아휴직등을 사용한 기간(출산전후휴가, 유산ㆍ사산 휴가 또는 육아휴직등을 사용하기 전 대체인력에 대한 2개월간의 업무 인수인계기간과 육아휴직을 사용한 근로자가 복직한 후 해당 근로자에 대한 1개월간의 업무 인수인계기간을 포함한다) 중 대체인력을 고용하거나 사용한 개월 수를 곱하여 산정한 금액으로 하되, 이 영 또는 다른 법령에 따라 국가 또는 지방자치단체가 해당 대체인력 고용ㆍ사용 또는 업무분담자 지정에 대하여 사업주에게 지급하는 지원금 또는 장려금 등이 있는 경우에는 그 지원금 또는 장려금 등의 금액을 뺀 금액으로 한다. 이 경우 대체인력지원금의 금액은 사업주가 해당 대체인력에게 지급한 임금액 또는 근로자파견의 대가를 초과할 수 없다. <개정 2012.7.10, 2013.1.25, 2013.12.24, 2015.6.30, 2016.12.30, 2018.12.31, 2021.12.31, 2024.6.25, 2024.12.24, 2025.12.23>
The Employment Stabilization Grant for Childbirth and Childcare Leave under paragraph ①, subparagraph 3 (hereinafter referred to as the "Replacement Personnel Support Grant"; hereinafter the same applies in this Article) shall be calculated by multiplying the number of months of employing or using replacement personnel during the period of maternity leave, miscarriage or stillbirth leave, or childcare leave, etc. (including a two-month handover period for replacement personnel prior to taking maternity leave, miscarriage or stillbirth leave, or childcare leave, etc., and a one-month handover period for the returning worker after childcare leave) by the amount determined and notified by the Minister of Employment and Labor, taking into account the employer's burden of labor costs for employing or using replacement personnel. 제1항제4호에 따른 출산육아기 고용안정장려금(이하 "업무분담지원금"이라 한다)은 업무분담자 지정에 따른 사업주의 노무비용부담을 고려하여 다음 각 호의 구분에 따라 정한 금액으로 하되, 이 영 또는 다른 법령에 따라 육아휴직등 및 배우자 출산전후휴가에 따른 업무분담자 지정 또는 대체인력의 고용ㆍ사용에 대해 사업주가 지원금 또는 장려금 등의 금전을 지급받은 경우에는 그 지원금 또는 장려금 등의 금액을 뺀 금액으로 한다. 이 경우 업무분담지원금의 금액은 사업주가 해당 업무분담자에게 지급한 금액을 초과할 수 없다. <신설 2024.6.25, 2024.12.24, 2026.6.30, 2026.8.18>
1. 제1항제4호가목에 해당하는 경우: 고용노동부장관이 정하여 고시하는 금액에 육아휴직등을 사용한 기간 중 업무분담자를 지정한 개월 수를 곱하여 산정한 금액
2. 제1항제4호나목에 해당하는 경우: 고용노동부장관이 정하여 고시하는 금액

제1항에 따른 출산육아기 고용안정장려금은 다음 각 호의 구분에 따라 지급한다. <신설 2020.3.31, 2021.12.31, 2024.6.25, 2024.12.24, 2025.6.2, 2025.12.23>
1. 제1항제2호에 해당하는 경우: 제3항에 따른 출산육아기 고용안정장려금의 100분의 50에 해당하는 금액은 사업주가 제1항제2호의 요건을 갖추면 지급하고, 나머지 금액은 해당 사업주가 육아휴직등을 사용한 근로자를 육아휴직등이 끝난 후 6개월 이상 피보험자로 계속 고용하는 경우(사업주가 해당 근로자의 자기 사정으로 인하여 6개월 이상 계속 고용하지 못한 경우를 포함한다)에 합산하여 한꺼번에 지급한다.
2. 제1항제3호에 해당하는 경우: 사업주가 제1항제3호의 요건을 갖추면 대체인력지원금의 100분의 100을 지급하되, 다음 각 목의 금액으로 구분하여 지급한다.
- 가. 출산전후휴가, 유산ㆍ사산 휴가 또는 육아휴직등을 사용하기 전 대체인력에 대한 2개월간의 업무 인수인계기간에 해당하는 대체인력지원금
- 나. 출산전후휴가, 유산ㆍ사산 휴가 또는 육아휴직등을 사용한 기간에 해당하는 대체인력지원금
- 다. 육아휴직을 사용한 근로자가 복직한 후 해당 근로자에 대한 1개월간의 업무 인수인계기간에 해당하는 대체인력지원금
3. 제1항제4호에 해당하는 경우: 사업주가 제1항제4호의 요건을 갖추면 업무분담지원금의 100분의 100을 지급한다.
