Article 47-2 (Living Expenses Loan During Vocational Skills Development Training)

법 제29조제3항에서 "대통령령으로 정하는 저소득 피보험자등"이란 다음 각 호의 어느 하나에 해당하는 사람 중 소득수준 및 종전의 대부실적 등을 고려하여 고용노동부장관이 정하여 고시하는 선정기준에 해당하는 사람을 말한다. <개정 2020.6.9>
1. 법 제2조제1호가목에 따른 피보험자로서 휴직수당 등 금품을 받지 않고 휴직 중인 사람
2. 자영업자인 피보험자
3. 법 제27조제2항 각 호의 어느 하나에 해당하는 피보험자등
4. 법 제29조제3항에 따른 생계비 대부 신청 시 실업상태에 있는 피보험자등이었던 사람(법 제4장에 따른 실업급여를 수급하고 있는 사람은 제외한다)
5. 제35조제5호바목에 해당하는 피보험자등
6. 그 밖에 생계비 대부가 필요하다고 고용노동부장관이 인정하는 피보험자등
In the case of Article 29, Paragraph 3 of the Act, “low-income insured persons, etc. as prescribed by Presidential Decree” means persons who meet the selection criteria determined and publicly announced by the Minister of Employment and Labor, taking into consideration their income level and previous loan performance, among those falling under any of the following subparagraphs. <Amended by Presidential Decree No. 30765, Jun. 9, 2020> 1. An insured person under Article 2(1)(a) of the Act who is on leave of absence without receiving severance pay or other compensation. 2. An insured person who is self-employed. 3. An insured person, etc. falling under any of the subparagraphs of Article 27(2) of the Act. 4. An insured person, etc. who was an insured person, etc. at the time of applying for a living expenses loan under Article 29(3) of the Act (excluding those receiving unemployment benefits under Chapter 4 of the Act). 5. An insured person, etc. falling under Article 35(5)(f). 6. Insured persons, etc. whom the Minister of Employment and Labor recognizes as needing a living expenses loan for other reasons.
법 제29조제3항에 따른 생계비는 예산의 범위에서 대부할 수 있다.
The living expenses under Article 29(3) of the Act may be loaned within the scope of the budget.
고용노동부장관은 직업능력개발훈련에 따른 생계비의 대부를 신청하는 사람에 대하여 제1항에 따른 대부 대상자 해당 여부의 확인절차를 거친 후에 대부 여부를 결정하여야 한다. <개정 2010.7.12>
The Minister of Employment and Labor shall decide whether to grant a loan after undergoing a confirmation procedure to determine whether the applicant meets the loan eligibility criteria under Paragraph ① for a living expenses loan for vocational skills development training. <Amended by Presidential Decree No. 22230, Jul. 12, 2010>
제3항에 따른 대부의 신청ㆍ결정 절차에 관한 사항, 대부결정의 취소에 관한 사항, 대부금액 및 상환방법, 그 밖에 대부제도의 운영에 필요한 사항은 고용노동부장관이 정하여 고시한다. <개정 2010.7.12>
Matters concerning the application and decision procedures for loans under Paragraph ③, matters concerning the cancellation of loan decisions, loan amounts and repayment methods, and other matters necessary for the operation of the loan system shall be determined and publicly announced by the Minister of Employment and Labor. <Amended by Presidential Decree No. 22230, Jul. 12, 2010>
