제73조 개별연장급여의 지급 등

법 제52조제1항에서 "대통령령으로 정하는 사람"이란 다음 각 호의 요건을 모두 갖춘 수급자격자를 말한다. <개정 2010.2.8, 2010.7.12, 2021.6.8>
1. 법 제42조제1항에 따른 실업신고일부터 구직급여의 지급이 끝날 때까지 직업안정기관의 장의 직업소개(직업안정기관의 장이 실시하는 심층상담이나 집단상담에 참여한 경우를 포함한다)에 3회 이상 응하였으나 취업되지 않은 사람으로서 다음 각 목의 어느 하나에 해당하는 부양가족이 있는 사람
- 가. 18세 미만이나 65세 이상인 사람
- 나. 「장애인고용촉진 및 직업재활법」에 따른 장애인
- 다. 1개월 이상의 요양이 요구되는 환자
- 라. 소득이 없는 배우자
- 마. 학업 중인 사람으로서 고용노동부장관이 정하여 고시하는 사람

3. 급여기초 임금일액과 본인과 배우자의 재산합계액이 각각 고용노동부장관이 정하여 고시한 기준 이하인 사람
The "person prescribed by Presidential Decree" in Article 52 (1) of the Act refers to a person who meets all of the following requirements. 1. A person who has applied for job placement by the head of a public employment security office (including participation in in-depth counseling or group counseling conducted by the head of a public employment security office) at least three times from the date of reporting unemployment under Article 42 (1) of the Act until the end of the period for which unemployment benefits are paid, but has not been employed, and has dependents falling under any of the following sub-paragraphs: a. Persons under 18 years of age or over 65 years of age b. Persons with disabilities under the 「Act on the Promotion of Employment and Vocational Rehabilitation of Persons with Disabilities」 c. Patients requiring medical treatment for one month or longer d. Spouse with no income e. Persons who are pursuing studies and are designated by the Minister of Employment and Labor through a notice 2. Deleted 3. A person whose daily base wage for benefit calculation and the total assets of the person and their spouse are each below the standards designated by the Minister of Employment and Labor through a notice.
법 제52조제2항에 따라 개별연장급여 지급일수는 최대한 60일로 하되, 일정 기간 동안 실업급여를 반복하여 수급한 정도를 고려하여 고용노동부장관이 정하는 기준에 따라 그 지급기간을 60일 미만으로 정할 수 있다. <개정 2010.12.31>
The maximum number of days for which individual extended benefits can be paid under Article 52 (2) of the Act shall be 60 days; however, the period of payment may be set at less than 60 days according to the standards determined by the Minister of Employment and Labor, taking into account the frequency of receiving unemployment benefits during a certain period.
수급자격자가 법 제52조에 따른 개별연장급여를 지급받으려는 경우에는 구직급여일수 종료일까지 개별연장급여 신청서를 신청지 관할 직업안정기관의 장에게 제출하여야 한다. <개정 2011.9.15, 2024.12.24>
If a person intends to receive individual extended benefits under Article 52 of the Act, they must submit an application for individual extended benefits to the head of the public employment security office having jurisdiction over the place of application by the end of the unemployment benefit payment period.
제1항에 따른 개별연장급여의 지급에 필요한 사항은 고용노동부령으로 정한다. <개정 2010.7.12>
