제79조 구직급여의 지급정지 절차

직업안정기관의 장은 다음 각 호의 어느 하나에 해당하는 사람에게는 구직급여의 지급이 정지될 수 있음을 고용노동부령으로 정하는 바에 따라 사전에 알려야 한다. <개정 2010.7.12, 2021.6.8>

1. 법 제60조제1항에 따라 직업안정기관의 장이 소개하는 직업에 취직하는 것을 거부하는 수급자격자
2. 법 제60조제1항에 따라 직업안정기관의 장이 지시한 직업능력개발훈련 등을 거부하는 수급자격자
3. 법 제60조제2항에 따라 직업안정기관의 장이 실시하는 재취업 촉진을 위한 직업 지도를 거부하는 수급자격자

The head of the employment stability agency shall, in accordance with the Enforcement Rule of the Ministry of Employment and Labor, give prior notice that the payment of job-seeking benefits may be suspended to a person falling under any of the following subparagraphs. <Amended by Act No. 10415, Jul. 12, 2010; Act No. 18234, Jun. 8, 2021> 1. A beneficiary who refuses employment introduced by the head of the employment stability agency pursuant to Article 60 (1) of this Act. 2. A beneficiary who refuses vocational skills development training, etc., instructed by the head of the employment stability agency pursuant to Article 60 (1) of this Act. 3. A beneficiary who refuses vocational guidance for re-employment promotion conducted by the head of the employment stability agency pursuant to Article 60 (2) of this Act.

직업안정기관의 장은 제1항에 따른 고지에도 불구하고 법 제60조제1항 및 제2항에 따른 취직, 직업능력개발훈련 등을 두 번 이상 거부하는 경우에는 구직급여의 지급을 정지하여야 한다.

If a beneficiary refuses employment, vocational skills development training, etc., pursuant to Article 60 (1) and (2) of this Act two or more times, despite the notification under paragraph ①, the head of the employment stability agency shall suspend the payment of job-seeking benefits.

직업안정기관의 장은 제2항에 따라 구직급여의 지급을 정지할 때에는 다음번 실업인정일의 전일까지 지급정지의 사유ㆍ기간 등을 수급자격자에게 알려야 하며, 그 지급정지기간에 대하여는 실업을 인정하지 아니한다.

When suspending the payment of job-seeking benefits pursuant to paragraph ②, the head of the employment stability agency shall notify the beneficiary of the reason and period of suspension, etc., by the day before the next unemployment recognition date, and unemployment shall not be recognized for the period of suspension of payment.
