제82조 상병급여의 지급 청구와 지급 제외

수급자격자는 법 제63조제1항에 따라 상병급여(傷病給與)의 지급을 청구하려는 경우 직접 또는 대리인을 통하여 그 취업할 수 없는 사유가 없어진 날부터 14일(법 제48조에 따른 수급기간이 그 취업할 수 없는 기간 내에 끝난 경우에는 수급기간 종료 후 30일) 이내에 신청지 관할 직업안정기관의 장에게 상병급여 청구서에 질병 또는 부상이나 출산에 관한 증명서를 첨부하여 제출하여야 한다. 다만, 천재지변이나 그 밖의 부득이한 사유가 있는 경우에는 그 사유가 없어진 날부터 7일 이내에 제출하여야 한다. <개정 2011.9.15, 2024.6.25>
An eligible recipient who intends to claim payment of sickness and injury allowance (傷病給與) pursuant to Article 63 (1) of the Act shall submit an application for sickness and injury allowance, along with a certificate concerning the illness, injury, or childbirth, to the head of the employment security office having jurisdiction over the place of application, within 14 days (or within 30 days after the end of the benefit period, if the benefit period under Article 48 of the Act ends within the period of inability to work) from the day on which the reason for inability to work ceases to exist, either directly or through an agent. However, in cases of natural disaster or other unavoidable reasons, the application shall be submitted within 7 days from the day on which such reason ceases to exist. <Amended by Presidential Decree No. 32174, Sep. 15, 2011; Presidential Decree No. 34687, Jun. 25, 2024>
법 제63조제4항에서 "대통령령으로 정하는 보상 또는 급여"란 다음 각 호의 보상과 급여를 말한다.
1. 「국가배상법」 제3조제2항제2호에 따른 휴업배상
2. 「의사상자 등 예우 및 지원에 관한 법률」 제8조에 따른 보상금
