법 제70조제1항에 따른 육아휴직 급여는 다음 각 호의 구분에 따른 금액을 월별 지급액으로 한다. <개정 2024.12.24>

1. 육아휴직 시작일부터 3개월까지: 육아휴직 시작일을 기준으로 한 월 통상임금에 해당하는 금액. 다만, 해당 금액이 250만원을 넘는 경우에는 250만원으로 하고, 해당 금액이 70만원보다 적은 경우에는 70만원으로 한다.
2. 육아휴직 4개월째부터 6개월째까지: 육아휴직 시작일을 기준으로 한 월 통상임금에 해당하는 금액. 다만, 해당 금액이 200만원을 넘는 경우에는 200만원으로 하고, 해당 금액이 70만원보다 적은 경우에는 70만원으로 한다.
3. 육아휴직 7개월째부터 종료일까지: 육아휴직 시작일을 기준으로 한 월 통상임금의 100분의 80에 해당하는 금액. 다만, 해당 금액이 160만원을 넘는 경우에는 160만원으로 하고, 해당 금액이 70만원보다 적은 경우에는 70만원으로 한다.

The parental leave allowance under Article 70 (1) of 「the Act on Equal Employment and Support for Work-Family Reconciliation」 shall be the monthly payment amount determined according to the following categories. <Amended by Act No. YYYY-MM-DD, YYYY-MM-DD> 1. From the seventh month to the end of parental leave: An amount equivalent to 80 percent of the monthly ordinary wage based on the start date of parental leave. However, if the amount exceeds 1,600,000 won, it shall be 1,600,000 won, and if it is less than 700,000 won, it shall be 700,000 won.

「남녀고용평등과 일ㆍ가정 양립 지원에 관한 법률」 제19조의4제1항에 따라 육아휴직을 분할하여 사용하는 경우에는 각각의 육아휴직 사용기간을 합산한 기간을 제1항에 따른 육아휴직 급여의 지급대상 기간으로 본다. <개정 2017.8.29, 2020.3.31>

육아휴직 급여의 지급대상 기간이 1개월을 채우지 못하는 경우에는 제1항에 따른 월별 지급액을 해당 월에 휴직한 일수에 비례하여 계산한 금액을 지급액으로 한다. <개정 2017.8.29, 2021.12.31>
