사업주와 공모하여 거짓이나 그 밖의 부정한 방법으로 다음 각 호에 따른 지원금 또는 급여를 받은 자와 공모한 사업주는 각각 5년 이하의 징역 또는 5천만원 이하의 벌금에 처한다. <개정 2020.6.9, 2021.1.5>
1. 제3장에 따른 고용안정ㆍ직업능력개발 사업의 지원금
2. 제4장에 따른 실업급여
3. 제5장에 따른 육아휴직 급여, 육아기 근로시간 단축 급여 및 출산전후휴가 급여등
4. 제5장의2 및 제5장의3에 따른 구직급여 및 출산전후급여등
An employer who conspires with a person who has received subsidies or benefits under the following subparagraphs by deceitful or other fraudulent means, and such person who conspired with the employer, shall each be punished by imprisonment of not more than 5 years or a fine of not more than 50 million won. <Amended by Act No. 17347, Jun. 9, 2020, Act No. 17874, Jan. 5, 2021> 1. Job-seeking benefits and benefits for prenatal and postnatal leave, etc. under Chapters 5-2 and 5-3
다음 각 호의 어느 하나에 해당하는 자는 3년 이하의 징역 또는 3천만원 이하의 벌금에 처한다. <개정 2020.6.9, 2021.1.5, 2022.12.31>
1. 제105조(제77조의5제3항ㆍ제4항 및 제77조의10제3항ㆍ제4항에서 준용하는 경우를 포함한다)를 위반하여 근로자를 해고하거나 그 밖에 근로자에게 불이익한 처우를 한 사업주
2. 거짓이나 그 밖의 부정한 방법으로 제1항 각 호에 따른 지원금 또는 급여를 받은 자. 다만, 제1항에 해당하는 경우는 제외한다.

An employer who dismisses a worker or otherwise treats a worker unfavorably in violation of Article 105 (including cases applied mutatis mutandis by paragraphs 3 and 4 of Article 77-5 and paragraphs 3 and 4 of Article 77-10). 2. A person who has received subsidies or benefits under the subparagraphs of paragraph ① by deceitful or other fraudulent means. However, cases falling under paragraph ① shall be excluded.
