Article 18 (Criteria for Acquisition of Insured Status)
제18조 피보험자격의 취득기준

제2조제1호가목에 따른 근로자가 보험관계가 성립되어 있는 둘 이상의 사업에 동시에 고용되어 있는 경우에는 대통령령으로 정하는 바에 따라 그 중 한 사업의 피보험자격을 취득한다.
Where a worker under Article 2, Clause 1, Subparagraph (a) is simultaneously employed by two or more businesses for which an insurance relationship has been established, the insured status shall be acquired for one of those businesses as prescribed by Presidential Decree.
제2조제1호가목 및 나목에 동시에 해당하는 사람은 같은 호 가목에 따른 근로자, 예술인 또는 노무제공자로서의 피보험자격을 취득한다. 다만, 제2조제1호가목에 따른 피보험자가 다음 각 호의 어느 하나에 해당하는 사람인 경우에는 같은 호 가목 및 나목의 피보험자격 중 하나를 선택하여 피보험자격을 취득하거나 유지한다.
1. 일용근로자
2. 제77조의2제2항제2호 단서에 따른 단기예술인
3. 제77조의6제2항제2호 단서에 따른 단기노무제공자
A person who simultaneously falls under Article 2, Clause 1, Subparagraphs (a) and (b) shall acquire insured status as a worker, artist, or labor provider under Article 2, Clause 1, Subparagraph (a). Provided, however, that where an insured person under Article 2, Clause 1, Subparagraph (a) falls under any of the following subparagraphs, they shall acquire or maintain insured status by selecting one of the insured statuses under Article 2, Clause 1, Subparagraphs (a) and (b): 1. Daily worker 2. Short-term artist under the proviso to Article 77-2, Clause 2, Subparagraph 2 3. Short-term labor provider under the proviso to Article 77-6, Clause 2, Subparagraph 2
제2항에도 불구하고 제2조제1호가목 및 나목에 동시에 해당하는 사람은 본인 의사에 따라 같은 호 가목 및 나목에 따른 피보험자격 모두를 취득하거나 유지할 수 있다.
Notwithstanding Article 2, where a person who simultaneously falls under Article 2, Clause 1, Subparagraphs (a) and (b) may acquire or maintain insured status for both Article 2, Clause 1, Subparagraphs (a) and (b) according to their own will.
제2조제1호가목에 따른 예술인 또는 노무제공자가 보험관계가 성립되어 있는 둘 이상의 사업에서 동시에 노무를 제공하거나 근로를 제공하는 경우에는 대통령령으로 정하는 바에 따라 피보험자격을 취득한다.
Where an artist or labor provider under Article 2, Clause 1, Subparagraph (a) simultaneously provides labor or performs work in two or more businesses for which an insurance relationship has been established, the insured status shall be acquired as prescribed by Presidential Decree.
