Article 43-2 (Recognition of Eligibility for Benefits When Acquiring Two or More Insured Qualifications)
제43조의2 둘 이상의 피보험자격 취득 시 수급자격의 인정

근로자, 제77조의2제1항에 따른 예술인, 제77조의6제1항에 따른 노무제공자 또는 자영업자인 피보험자로서 서로 다른 둘 이상의 피보험자격을 취득하였다가 이직하여 그 피보험자격을 모두 상실한 사람이 구직급여를 지급받으려는 경우에는 둘 이상의 피보험자격 중 자신이 선택한 피보험자격을 기준으로 수급자격의 인정 여부를 결정한다.
When an insured person who is an employee, an artist under Article 77-2(1), a worker under Article 77-6(1), or a self-employed person, has acquired two or more different insured qualifications and subsequently separated from employment and lost all of those insured qualifications, and wishes to receive unemployment benefits, the eligibility for benefits shall be determined based on the insured qualification chosen by that person from among the two or more insured qualifications.
제1항에 따라 수급자격을 인정받으려는 사람이 선택한 피보험자격이 가장 나중에 상실한 피보험자격(피보험자격을 동시에 상실한 경우에는 동시에 상실된 피보험자격 모두를 말한다. 이하 이 항에서 같다)이 아닌 경우에는 가장 나중에 상실한 피보험자격과 관련된 이직사유가 제58조 또는 제69조의7에 따른 수급자격의 제한 사유에 해당하지 아니하는 경우에만 수급자격을 인정한다. 다만, 직업안정기관의 장이 대통령령으로 정하는 바에 따른 소득감소로 이직하였다고 인정하는 경우에는 수급자격의 제한 사유에 해당하지 아니하는 것으로 본다.
If the insured qualification chosen by a person who wishes to be recognized for eligibility for benefits under paragraph (1) is not the insured qualification most recently lost (in cases where insured qualifications are lost simultaneously, this refers to all insured qualifications lost simultaneously; hereinafter the same applies in this paragraph), eligibility for benefits shall only be recognized if the reason for separation from employment related to the most recently lost insured qualification does not fall under the grounds for restriction of eligibility for benefits under Article 58 or Article 69-7. Provided, however, that if the head of the employment security office recognizes that the separation from employment was due to a reduction in income as prescribed by Presidential Decree, it shall be deemed not to fall under the grounds for restriction of eligibility for benefits.
