Article 57 (Unpaid Job-Seeking Benefits)
제57조 지급되지 아니한 구직급여

수급자격자가 사망한 경우 그 수급자격자에게 지급되어야 할 구직급여로서 아직 지급되지 아니한 것이 있는 경우에는 그 수급자격자의 배우자(사실상의 혼인 관계에 있는 사람을 포함한다)ㆍ자녀ㆍ부모ㆍ손자녀ㆍ조부모 또는 형제자매로서 수급자격자와 생계를 같이하고 있던 사람의 청구에 따라 그 미지급분을 지급한다. <개정 2020.5.26>
Where a person eligible for benefits dies, if there are any job-seeking benefits that should have been paid to the person eligible for benefits but have not yet been paid, such unpaid amount shall be paid upon the claim of the person eligible for benefits' spouse (including a person in a de facto marital relationship), child, parent, grandchild, grandparent, or sibling who lived with the person eligible for benefits and shared living expenses. <Amended by Act No. 17248, May 26, 2020>
수급자격자가 사망하여 실업의 인정을 받을 수 없었던 기간에 대하여는 대통령령으로 정하는 바에 따라 제1항에 따라 지급되지 아니한 구직급여의 지급을 청구하는 사람이 그 수급자격자에 대한 실업의 인정을 받아야 한다. 이 경우 수급자격자가 제47조제1항에 해당하면 지급되지 아니한 구직급여를 청구하는 사람이 같은 조 제1항에 따라 직업안정기관의 장에게 신고하여야 한다. <개정 2020.5.26>
For the period during which the person eligible for benefits could not receive recognition of unemployment due to death, the person claiming the payment of unpaid job-seeking benefits under paragraph ① shall receive recognition of unemployment for the deceased person eligible for benefits, as prescribed by Presidential Decree. In this case, if the person eligible for benefits falls under Article 47(1), the person claiming the unpaid job-seeking benefits shall report to the head of the employment security agency under Article 47(1). <Amended by Act No. 17248, May 26, 2020>
제1항에 따라 지급되지 아니한 구직급여를 지급받을 수 있는 사람의 순위는 같은 항에 열거된 순서로 한다. 이 경우 같은 순위자가 2명 이상이면 그 중 1명이 한 청구를 전원(全員)을 위하여 한 것으로 보며, 그 1명에게 한 지급은 전원에 대한 지급으로 본다. <개정 2020.5.26>
The order of priority for persons who can receive unpaid job-seeking benefits under paragraph ① shall be in the order listed in the same paragraph. In this case, if there are two or more persons of the same priority, a claim made by one of them shall be deemed to have been made for all of them, and payment made to one of them shall be deemed to have been made to all of them. <Amended by Act No. 17248, May 26, 2020>
