Article 9 (Measures for Smoking Cessation)

Retailers designated under the Tobacco Business Act, and other persons selling tobacco, shall not sell tobacco by installing cigarette vending machines in places other than those prescribed by Presidential Decree.

The owner, possessor, or manager of the following facilities used by the public shall designate the entire facility as a non-smoking area and install signs indicating the non-smoking area. In this case, smoking rooms may be installed for smokers, and the standards and methods for installing signs indicating non-smoking areas and smoking rooms shall be prescribed by the Ministry of Health and Welfare Ordinance. <Amended 2011.6.7, 2014.1.21, 2016.12.2, 2017.12.30, 2021.12.21, 2025.4.1> 1. Buildings of the National Assembly 2. Buildings of the central government and local governments 3. Courts and their affiliated agencies under the 「Court Organization Act」 4. Buildings of public institutions under the 「Act on the Management of Public Institutions」 5. Buildings of local public enterprises under the 「Local Public Enterprise Act」 6. Schools under the 「Early Childhood Education Act」 and the 「Elementary and Secondary Education Act」 (including all areas such as school buildings and playgrounds) 6.2. Alternative education institutions under the 「Act on Alternative Education Institutions」 (including all areas such as school buildings and playgrounds) 7. School buildings under the 「Higher Education Act」 8. Medical institutions under the 「Medical Service Act」, and public health centers, public health medical centers, and public health clinics under the 「Regional Public Health Act」 9. Childcare centers under the 「Infant and Child Care Act」 10. Youth activity facilities such as youth training centers, youth training institutes, youth cultural centers, youth specialized facilities, youth camps, youth hostels, and youth recreation facilities under the 「Youth Activity Promotion Act」 11. Libraries under the 「Library Act」 12. Children's play facilities under the 「Act on the Safety Management of Children's Play Facilities」 13. Academies under the 「Act on the Establishment and Operation of Academies and Extracurricular Tutoring」, among which are academies teaching school curriculum and academies with a total floor area of 1,000 square meters or more 14. Waiting rooms and platforms of transportation-related facilities such as airports, passenger terminals, train stations, and passenger bus terminals, underground passages, and vehicles with 16 or more seats that transport passengers or cargo for remuneration 15. Vans for transporting children under the 「Automotive Management Act」 16. Office buildings, factories, and multi-purpose buildings with a total floor area of 1,000 square meters or more 17. Performance halls under the 「Act on Performances」 with 300 or more seats 18. Large-scale retail stores registered under the 「Distribution Industry Development Act」 and shopping districts located underground among shopping districts under the same Act 19. Tourist accommodation facilities under the 「Tourism Promotion Act」 20. Sports facilities under the 「Act on the Installation and Use of Sports Facilities」 that can accommodate 1,000 or more spectators, and indoor sports facilities that fall under sports facility businesses under Article 10 of the same Act 21. Social welfare facilities under the 「Social Welfare Services Act」 22. Bathhouses under the 「Public Health Control Act」 23. Youth game providers, general game providers, internet computer game facilities providers, and combined distribution game providers under the 「Game Industry Promotion Act」 24. Food service businesses under the 「Food Sanitation Act」, including rest areas, general restaurants, and bakeries with a business area exceeding the area prescribed by the Ministry of Health and Welfare Ordinance, and food vending machine businesses under the same Act that operate with an indoor rest area exceeding the area prescribed by the Ministry of Health and Welfare Ordinance for food subdivision and sales businesses 25. Comic book rental businesses under the 「Youth Protection Act」 26. Other facilities or institutions prescribed by the Ministry of Health and Welfare Ordinance

The special mayor, special provincial governor, mayor, county governor, or district mayor shall designate the following areas as non-smoking areas to prevent harm from smoking and promote the health of residents, and install signs indicating the non-smoking areas. In this case, matters necessary for the methods of installing signs indicating non-smoking areas shall be prescribed by the Ministry of Health and Welfare Ordinance. <Newly established 2017.12.30, 2023.8.16> 1. Areas within 30 meters from the boundary of kindergarten facilities under the 「Early Childhood Education Act」 (referring to areas provided for general public passage and use) 2. Areas within 30 meters from the boundary of childcare center facilities under the 「Infant and Child Care Act」 (referring to areas provided for general public passage and use) 3. Areas within 30 meters from the boundary of school facilities under the 「Elementary and Secondary Education Act」 (referring to areas provided for general public passage and use)

No person shall smoke in the non-smoking areas designated pursuant to paragraphs (4) through (7). <Amended 2010.5.27, 2016.3.2, 2017.12.30>
