「담배사업법」에 따른 담배의 제조자 또는 수입판매업자(이하 "제조자등"이라 한다)는 담배갑포장지 앞면ㆍ뒷면ㆍ옆면 및 대통령령으로 정하는 광고(판매촉진 활동을 포함한다. 이하 같다)에 다음 각 호의 내용을 인쇄하여 표기하여야 한다. 다만, 제1호의 표기는 담배갑포장지에 한정하되 앞면과 뒷면에 하여야 한다. <개정 2015.6.22>
1. 흡연의 폐해를 나타내는 내용의 경고그림(사진을 포함한다. 이하 같다)
2. 흡연이 폐암 등 질병의 원인이 될 수 있다는 내용 및 다른 사람의 건강을 위협할 수 있다는 내용의 경고문구
3. 타르 흡입량은 흡연자의 흡연습관에 따라 다르다는 내용의 경고문구
4. 담배에 포함된 다음 각 목의 발암성물질
- 가. 나프틸아민
- 나. 니켈
- 다. 벤젠
- 라. 비닐 크롤라이드
- 마. 비소
- 바. 카드뮴
5. 보건복지부령으로 정하는 금연상담전화의 전화번호
Manufacturers or importers and sellers of tobacco under the 「Tobacco Business Act」 (hereinafter referred to as "manufacturers, etc.") shall print and display the following contents on the front, back, and sides of tobacco packaging and in advertisements (including sales promotion activities; hereinafter the same shall apply) as prescribed by Presidential Decree: Provided, That the display under item 1 shall be limited to tobacco packaging and shall be on the front and back thereof. <Amended by Act No. 13382, Jun. 22, 2015> 1. A warning graphic image (including photographs; hereinafter the same shall apply) indicating the harmful effects of smoking. 2. Warning statements stating that smoking may cause diseases such as lung cancer, and may threaten the health of others. 3. Warning statements stating that tar inhalation amounts vary according to the smoker's smoking habits. 4. Carcinogenic substances included in tobacco as follows: a. Naphthylamine b. Nickel c. Benzene d. Vinyl chloride e. Arsenic f. Cadmium 5. The telephone number for the smoking cessation consultation call center as prescribed by the Ordinance of the Ministry of Health and Welfare.
제1항에 따른 경고그림과 경고문구는 담배갑포장지의 경우 그 넓이의 100분의 50 이상에 해당하는 크기로 표기하여야 한다. 이 경우 경고그림은 담배갑포장지 앞면, 뒷면 각각의 넓이의 100분의 30 이상에 해당하는 크기로 하여야 한다. <신설 2015.6.22>
In the case of tobacco packaging, the warning graphic images and warning statements under paragraph ① shall be displayed in a size covering at least 50/100 of the area thereof. 제1항 및 제2항에서 정한 사항 외의 경고그림 및 경고문구 등의 내용과 표기 방법ㆍ형태 등의 구체적인 사항은 대통령령으로 정한다. 다만, 경고그림은 사실적 근거를 바탕으로 하고, 지나치게 혐오감을 주지 아니하여야 한다. <개정 2015.6.22>
Specific details regarding the content, method, and form of warning graphic images and warning statements, etc., other than those prescribed in paragraphs ① and ②, shall be determined by Presidential Decree: Provided, That warning graphic images shall be based on factual grounds and shall not cause excessive disgust. <Amended by Act No. 13382, Jun. 22, 2015>
제1항부터 제3항까지의 규정에도 불구하고 전자담배 등 대통령령으로 정하는 담배에 제조자등이 표기하여야 할 경고그림 및 경고문구 등의 내용과 그 표기 방법ㆍ형태 등은 대통령령으로 따로 정한다. <신설 2014.5.20, 2015.6.22>
