Article 20 (Exclusion of Mediation Members, etc.)
제20조 조정위원의 제척 등

조정위원이 다음 각 호의 어느 하나에 해당하는 경우 그 직무의 집행에서 제척된다.
1. 조정위원 또는 그 배우자나 배우자이었던 사람이 해당 분쟁사건의 당사자가 되는 경우
2. 조정위원이 해당 분쟁사건의 당사자와 친족관계에 있거나 있었던 경우
3. 조정위원이 해당 분쟁사건에 관하여 진술, 감정 또는 법률자문을 한 경우
4. 조정위원이 해당 분쟁사건에 관하여 당사자의 대리인으로서 관여하거나 관여하였던 경우
A mediation member shall be excluded from performing their duties in any of the following cases: 1. Where the mediation member, or their spouse or former spouse, is a party to the dispute concerned 2. Where the mediation member is or was related to a party to the dispute concerned 3. Where the mediation member has given testimony, an appraisal or legal advice on the dispute concerned 4. Where the mediation member is or was involved in the dispute concerned as an agent of a party
사건을 담당한 조정위원에게 제척의 원인이 있는 경우에는 조정위원회는 직권 또는 당사자의 신청에 따라 제척의 결정을 한다.
Where a ground for exclusion exists with respect to a mediation member handling a case, the Mediation Committee shall decide on the exclusion ex officio or upon the application of a party.
당사자는 사건을 담당한 조정위원에게 공정한 직무집행을 기대하기 어려운 사정이 있는 경우 조정위원회에 기피신청을 할 수 있다.
Where circumstances make it difficult to expect fair performance of duties by a mediation member handling a case, a party may file an application for challenge with the Mediation Committee.
기피신청에 관한 결정은 조정위원회가 하고, 해당 조정위원 및 당사자 쌍방은 그 결정에 불복하지 못한다.
A decision on an application for challenge shall be made by the Mediation Committee, and neither the mediation member concerned nor either party may contest that decision.
제3항에 따른 기피신청이 있는 때에는 조정위원회는 그 신청에 대한 결정이 있을 때까지 조정절차를 정지하여야 한다.
Where an application for challenge is filed under paragraph (3), the Mediation Committee shall suspend the mediation proceedings until a decision on the application is made.
조정위원은 제1항 또는 제3항에 해당하는 경우 조정위원회의 허가를 받지 아니하고 해당 분쟁사건의 직무집행에서 회피할 수 있다.
A mediation member falling under paragraph (1) or (3) may recuse themselves from performing duties in the dispute concerned without the Mediation Committee's permission.
