제1조의2 정보화기기를 이용한 출입국심사

다음 각 호의 요건을 모두 갖춘 국민은 법 제3조제2항 및 제6조제3항에 따라 정보화기기에 의한 출입국심사를 받을 수 있다. 이 경우 주민등록증을 발급받은 사람으로서 정보화기기를 이용한 출입국심사에 지장이 없는 경우에는 제2호의 요건을 갖춘 것으로 본다. <개정 2012.1.13, 2012.2.28, 2013.5.31, 2014.10.28, 2016.7.5, 2019.6.11>

1. 유효한 여권을 가지고 있을 것
2. 법무부령으로 정하는 바에 따라 스스로 지문과 얼굴에 관한 정보를 등록하였을 것
3. 법 제4조제1항ㆍ제2항에 따른 출국금지 또는 법 제4조의6제1항에 따른 긴급출국금지 대상이 아닌 사람으로서 다음 각 목의 어느 하나에 해당할 것
1. 가. 14세 이상으로 주민등록이 되어 있을 것
2. 나. 7세 이상 14세 미만의 사람으로서 주민등록이 되어 있고, 법정대리인의 동의를 받아 제2호의 지문과 얼굴에 관한 정보를 등록하였을 것
4. 그 밖에 「여권법」에 따라 사용이 제한되거나 반납명령을 받은 여권을 가지고 있는 등 출입국관리공무원의 심사가 필요한 경우에 해당하지 아니할 것

A national who meets all of the following requirements may undergo immigration inspection using information technology equipment pursuant to Article 3(2) and Article 6(3) of this Act. In such cases, a person who has been issued a resident registration card and for whom immigration inspection using information technology equipment is not hindered shall be deemed to have met the requirements of subparagraph 2. <Amended by Act No. 11617, Jan. 13, 2012; Act No. 11661, Feb. 28, 2012; Act No. 11816, May 31, 2013; Act No. 12714, Oct. 28, 2014; Act No. 14254, Jul. 5, 2016; Act No. 16451, Jun. 11, 2019> 1. Possesses a valid passport 2. Has registered information regarding fingerprints and facial features themselves according to the Minister of Justice's Ordinance 3. Is not subject to exit prohibition under Article 4(1) and (2) or emergency exit prohibition under Article 4-6(1) of this Act, and falls under any of the following: a. Is 14 years of age or older and has resident registration b. Is between 7 and under 14 years of age, has resident registration, and has registered information regarding fingerprints and facial features under subparagraph 2 with the consent of a legal representative 4. Is not in a situation requiring immigration control officer's inspection, such as possessing a passport whose use is restricted or for which a return order has been issued under the 「Passport Act」

제1항에 따라 출입국심사를 마친 사람에 대해서는 제1조제3항 본문에 따른 출국심사인이나 입국심사인의 날인을 생략한다. <개정 2016.9.29>

제1항제2호에 따른 등록 절차와 방법 등에 관한 사항은 법무부령으로 정한다.

Matters concerning the procedures and methods of registration under paragraph (1) subparagraph 2 shall be prescribed by the Minister of Justice's Ordinance.
