제101조(민감정보 및 고유식별정보의 처리) 법무부장관, 청장ㆍ사무소장ㆍ출장소장ㆍ보호소장, 외국인보호위원회, 시장ㆍ군수ㆍ구청장 또는 읍장ㆍ면장ㆍ동장(해당 권한이 위임ㆍ위탁된 경우에는 그 권한을 위임ㆍ위탁받은 자를 포함한다)은 법 또는 이 영에 따른 국민의 출입국심사, 외국인의 출입국심사와 상륙ㆍ체류 관련 허가, 체류관리 및 각종 신고, 외국인 등록ㆍ조사ㆍ보호, 강제퇴거, 외국인보호위원회의 심의ㆍ의결사항, 선박등의 검색, 선박등의 장이나 운수업자의 보고, 난민 인정, 사실증명 발급, 남북왕래에 관한 사무 및 그 밖에 이에 준하는 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 사상ㆍ신념, 건강에 관한 정보, 같은 법 시행령 제18조제1호 또는 제2호에 따른 유전정보 또는 범죄경력자료에 해당하는 정보, 같은 영 제19조제1호, 제2호 또는 제4호에 따른 주민등록번호, 여권번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2012.2.28, 2016.9.29, 2018.5.8, 2025.5.27>
