①

법 제102조의2제1항 전단에서 "대통령령으로 정하는 범칙금 납부대행기관"이란 다음 각 호의 기관 중에서 같은 항 후단에 따라 법무부장관이 범칙금 납부대행기관으로 지정하는 기관을 말한다.

1. 「민법」 제32조에 따라 금융위원회의 허가를 받아 설립된 금융결제원
2. 그 밖에 시설, 업무수행능력, 자본금 규모 등을 고려하여 범칙금 납부대행업무를 수행하기에 적합하다고 법무부장관이 인정하는 기관

The "deposit agency for penalty surcharges" as referred to in the first part of Article 102-2(1) of the Act means an agency designated by the Minister of Justice as a deposit agency for penalty surcharges in accordance with the latter part of the same paragraph, among the agencies listed in the following subparagraphs. 1. The Korea Financial Telecommunications and Clearings Institute established with permission from the Financial Services Commission under Article 32 of the Civil Act. 2. Other agencies deemed suitable by the Minister of Justice to perform the duties of depositing penalty surcharges, considering facilities, ability to perform duties, capital size, etc.

법무부장관은 법 제102조의2제1항 후단에 따라 범칙금 납부대행기관을 지정하는 경우에는 그 지정 사실을 관보에 고시해야 한다.

When the Minister of Justice designates a deposit agency for penalty surcharges under the latter part of Article 102-2(1) of the Act, he/she shall publish the fact of designation in the Official Gazette.

범칙금 납부대행기관은 법 제102조의2제3항에 따라 해당 범칙금액[법 제103조제1항에 따른 범칙금의 양정기준(量定基準)에 따라 가중된 금액을 포함한다]의 1천분의 15를 초과하지 않는 범위에서 범칙금 납부자로부터 납부대행 수수료를 받을 수 있다.

A deposit agency for penalty surcharges may receive a deposit agency fee from the person paying the penalty surcharge, within the scope not exceeding fifteen one-thousandths (15/1000) of the relevant penalty surcharge amount (including the amount increased according to the sentencing criteria for penalty surcharges under Article 103(1) of the Act), pursuant to Article 102-2(3) of the Act.

범칙금 납부대행기관은 제3항에 따른 납부대행 수수료에 대하여 법무부장관의 승인을 받아야 한다. 이 경우 법무부장관은 범칙금 납부대행기관의 운영경비 등을 종합적으로 고려하여 납부대행 수수료를 승인해야 한다.

A deposit agency for penalty surcharges shall obtain approval from the Minister of Justice for the deposit agency fee under paragraph ③. In this case, the Minister of Justice shall approve the deposit agency fee after comprehensively considering the operating expenses of the deposit agency for penalty surcharges, etc.
