제16조 조건부 입국허가

청장ㆍ사무소장 또는 출장소장은 법 제13조제1항에 따라 조건부 입국을 허가할 때에는 72시간의 범위에서 허가기간을 정할 수 있다. <개정 2018.5.8>
The Commissioner, the head of an office, or the head of a branch office may determine the permit period within 72 hours when granting a conditional entry permit under Article 13(1) of the Act. <Amended by Act No. 15552, May 8, 2018>
청장ㆍ사무소장 또는 출장소장은 조건부 입국허가를 받은 외국인이 부득이한 사유로 그 허가기간 내에 조건을 갖추지 못하였거나 조건을 갖추지 못할 것으로 인정될 때에는 제1항의 허가기간을 초과하지 아니하는 범위에서 조건부 입국허가기간을 연장할 수 있다. <개정 2018.5.8>
If a foreigner who has received a conditional entry permit is unable to satisfy the conditions within the permit period due to unavoidable reasons, or if it is recognized that the conditions will not be met, the Commissioner, the head of an office, or the head of a branch office may extend the conditional entry permit period within the scope of not exceeding the permit period under Paragraph ①. <Amended by Act No. 15552, May 8, 2018>
출입국관리공무원은 조건부 입국허가를 받은 외국인이 그 허가기간 내에 법 제12조제3항 각 호의 요건을 갖추었다고 인정되면 제15조제1항부터 제3항까지의 규정에 따라 입국심사를 하여야 한다. 이 경우 입국일은 조건부 입국허가일로 한다. <개정 2016.9.29>
If an immigration official recognizes that a foreigner who has received a conditional entry permit satisfies the requirements under each subparagraph of Article 12(3) of the Act within the permit period, the official shall conduct an entry examination in accordance with Articles 15(1) through 15(3). In this case, the entry date shall be the date of the conditional entry permit. <Amended by Act No. 14327, Sep. 29, 2016>
출입국관리공무원은 제3항에 따라 입국심사를 할 때에는 그 외국인의 조건부 입국허가서를 회수하여야 한다.
When conducting an entry examination under Paragraph ③, the immigration official shall confiscate the foreigner's conditional entry permit.
출입국관리공무원은 조건부 입국허가를 받은 외국인이 제3항에 따른 입국심사를 받지 아니하고 출국할 때에는 조건부 입국허가서를 회수하여야 한다.
If a foreigner who has received a conditional entry permit departs the country without undergoing the entry examination under Paragraph ③, the immigration official shall confiscate the conditional entry permit.
