법무부장관은 법 제4조제1항 또는 제2항에 따라 출국을 금지하려는 경우에는 관계 기관의 장에게 의견을 묻거나 관련 자료를 제출하도록 요청할 수 있다. <개정 2012.1.13>

중앙행정기관의 장 및 법무부장관이 정하는 관계 기관의 장은 법 제4조제3항에 따라 출국금지를 요청하는 경우에는 출국금지 요청 사유와 출국금지 예정기간 등을 적은 출국금지 요청서에 법무부령으로 정하는 서류를 첨부하여 법무부장관에게 보내야 한다. 다만, 시장ㆍ군수 또는 구청장(「제주특별자치도 설치 및 국제자유도시 조성을 위한 특별법」 제11조에 따른 행정시장을 포함하며, 구청장은 자치구의 구청장을 말한다. 이하 같다)의 소관 업무에 관한 출국금지 요청은 특별시장ㆍ광역시장 또는 도지사(특별자치도지사를 포함한다. 이하 같다)가 하되, 「지방자치법」 제198조제2항제1호에 따른 인구 100만 이상 대도시의 장은 직접 출국금지 요청을 한다. <개정 2012.1.13, 2016.1.22, 2023.12.12>

When the head of a central administrative agency or the head of a relevant agency designated by the Minister of Justice requests departure prohibition pursuant to Article 4 (3) of the Act, he/she shall send a departure prohibition request form, stating the grounds for the departure prohibition request and the planned departure prohibition period, to the Minister of Justice, attaching documents prescribed by the Ordinance of the Ministry of Justice. Provided, That departure prohibition requests concerning affairs under the jurisdiction of a mayor, county governor, or district governor (including administrative mayors under Article 11 of the Special Act on the Establishment of Jeju Special Self-Governing Province and the Creation of a Free International City; hereafter in this paragraph, "district governor" refers to the governor of an autonomous district) shall be made by a mayor of a metropolitan city, mayor of a city or provincial governor (including the governor of a special self-governing province; hereafter in this paragraph, the same shall apply). However, the head of a large city with a population of 1 million or more under Article 198 (2) 1. of the Local Autonomy Act shall directly request departure prohibition. <Amended by Act No. 11179, Jan. 13, 2012; Act No. 13897, Jan. 22, 2016; Act No. 19859, Dec. 12, 2023>

제2항 본문에 따른 출국금지 예정기간은 법 제4조제1항 또는 제2항에 따른 출국금지기간을 초과할 수 없다. <개정 2012.1.13>
