제46조 외국인등록증의 반납 등

출입국관리공무원은 법 제37조제1항 및 제5항에 따라 외국인등록증을 반납받은 때에는 그 외국인의 출국사실을 지체 없이 체류지 관할 청장ㆍ사무소장 또는 출장소장에게 통보하여야 한다. <개정 2018.5.8>
When an immigration control official receives an alien registration card pursuant to Articles 37(1) and 37(5) of the Act, he/she shall promptly notify the head of the competent regional immigration office, branch office, or satellite office of the fact that the alien has departed.
등록외국인이 법 제37조제2항에 따라 외국인등록증을 반납하는 시기와 방법은 다음 각 호의 구분에 따른다. <개정 2016.9.29, 2018.5.8>
1. 등록외국인이 국민이 된 경우에는 주민등록을 마친 날부터 30일 이내에 본인ㆍ배우자ㆍ부모 또는 제89조제1항에 규정된 사람이 외국인등록증을 체류지 관할 청장ㆍ사무소장 또는 출장소장에게 반납하여야 한다.
2. 등록외국인이 사망한 경우에는 그 배우자ㆍ부모, 제89조제1항에 규정된 사람이 그 사망을 안 날부터 30일 이내에 외국인등록증에 진단서 또는 검안서나 그 밖에 사망 사실을 증명하는 서류를 첨부하여 체류지 관할 청장ㆍ사무소장 또는 출장소장에게 반납하여야 한다.
3. 등록외국인이 법 제31조제1항 각 호의 어느 하나에 해당하게 된 경우에는 체류자격 변경허가를 받을 때에 외국인등록증을 체류지 관할 청장ㆍ사무소장 또는 출장소장에게 반납하여야 한다.
The time and method for a registered alien to return his/her alien registration card pursuant to Article 37(2) of the Act shall be as follows: 1. If a registered alien becomes a national of the Republic of Korea, the alien registration card shall be returned to the head of the competent regional immigration office, branch office, or satellite office by the alien himself/herself, his/her spouse, parents, or a person prescribed in Article 89(1) within 30 days from the date of completing the resident registration. 2. If a registered alien dies, his/her spouse, parents, or a person prescribed in Article 89(1) shall return the alien registration card to the head of the competent regional immigration office, branch office, or satellite office within 30 days from the date of becoming aware of the death, attaching a medical certificate, post-mortem examination certificate, or other document proving the fact of death. 3. If a registered alien falls under any of the subparagraphs of Article 31(1) of the Act, the alien registration card shall be returned to the head of the competent regional immigration office, branch office, or satellite office at the time of receiving permission to change his/her period of sojourn.
체류지 관할 청장ㆍ사무소장 또는 출장소장은 제1항 및 제2항에 따라 외국인의 출국사실을 통보받거나 외국인등록증을 반납받은 때에는 그 체류지의 시ㆍ군ㆍ구 및 읍ㆍ면ㆍ동의 장에게 외국인등록 말소통보를 하여야 한다. <개정 2018.5.8, 2018.9.18>
When the head of the competent regional immigration office, branch office, or satellite office is notified of the fact that an alien has departed or receives an alien registration card pursuant to paragraphs ① and ②, he/she shall notify the head of the competent city, county, district, town, township, or village of the alien's place of sojourn of the cancellation of alien registration.
제3항에 따른 통보를 받은 시ㆍ군ㆍ구 및 읍ㆍ면ㆍ동의 장은 지체 없이 외국인등록표를 정리하여야 한다. <개정 2018.9.18>
The head of the city, county, district, town, township, or village who receives a notification under paragraph ③ shall promptly update the alien registration ledger.
청장ㆍ사무소장 또는 출장소장은 법 제37조제4항에 따라 외국인등록증을 일시 보관하는 경우에는 보관물 대장에 그 사실을 적은 후 보관증을 발급하고, 이를 보관한 후 같은 조 제5항에 따른 반환요청이 있을 때에는 보관하고 있는 외국인등록증을 즉시 돌려주어야 한다. <개정 2018.5.8>
When the head of a regional immigration office, branch office, or satellite office temporarily keeps an alien registration card pursuant to Article 37(4) of the Act, he/she shall record the fact in the register of stored items, issue a receipt for the stored item, and immediately return the stored alien registration card upon receiving a request for return pursuant to Article 37(5) of the Act.
제1항 및 제2항에 따라 외국인등록증을 반납받은 출입국관리공무원 및 청장ㆍ사무소장ㆍ출장소장은 제1항 및 제3항에 따른 절차를 마친 후 그 외국인등록증을 파기한다. <신설 2015.6.15, 2018.5.8>
An immigration control official or the head of a regional immigration office, branch office, or satellite office who receives an alien registration card pursuant to paragraphs ① and ② shall destroy the alien registration card after completing the procedures under paragraphs ① and ③.
