출입국관리공무원은 법 제51조제1항 또는 이 영 제78조제1항에 따라 보호명령서가 발급된 외국인을 외국인보호실, 외국인보호소 또는 그 밖에 법무부장관이 지정하는 장소(이하 "보호시설"이라 한다)에 보호하려면 소속 청장ㆍ사무소장ㆍ출장소장 또는 보호소장으로부터 보호의뢰의 사유 및 근거를 적은 보호의뢰서를 발급받아 이를 보호의뢰를 받는 보호시설의 장에게 보내야 한다. <개정 2018.5.8, 2025.5.27>

If an immigration control official is to protect a foreigner for whom a protection order has been issued under Article 51 (1) of the Act or Article 78 (1) of this Decree in a foreigner detention center, a foreigner protection center, or any other place designated by the Minister of Justice (hereinafter referred to as "protection facility"), the official shall receive a referral for protection, stating the grounds and basis for the referral, from the head of the competent bureau, office, branch office, or center, and send it to the head of the protection facility receiving the referral.

출입국관리공무원은 제1항에 따라 보호의뢰한 외국인이 다음 각 호의 어느 하나에 해당하는 사유가 있으면 다른 보호시설로 보호장소를 변경할 수 있다.

1. 법에 따른 외국인에 대한 조사
2. 출국집행
3. 보호시설 내 안전 및 질서유지
4. 외국인에 대한 의료제공 등 필요한 처우

If a foreigner referred for protection under paragraph ① falls under any of the following subparagraphs, an immigration control official may change the place of protection to another protection facility. 1. Investigation of a foreigner under the Act 2. Execution of departure 3. Maintenance of safety and order within a protection facility 4. Necessary treatment, such as providing medical care to a foreigner

출입국관리공무원은 제2항에 따라 보호장소를 변경하려면 소속 청장ㆍ사무소장ㆍ출장소장 또는 보호소장으로부터 보호장소의 변경사유 등을 적은 보호장소 변경 의뢰서를 발급받아 그 외국인을 보호하고 있는 보호시설의 장과 변경되는 보호시설의 장에게 각각 보내야 한다. <개정 2018.5.8>

If an immigration control official is to change the place of protection under paragraph ②, the official shall receive a referral for change of protection place, stating the grounds for the change, from the head of the competent bureau, office, branch office, or center, and send it to the head of the protection facility where the foreigner is currently protected and the head of the protection facility to which the foreigner will be moved, respectively.

출입국관리공무원은 법 제51조제4항에 따라 긴급보호서를 작성할 때에는 긴급보호의 사유, 보호장소 및 보호시간 등을 적어야 한다.

When an immigration control official prepares an emergency protection order under Article 51 (4) of the Act, the official shall state the grounds for emergency protection, the place of protection, and the period of protection.
