제70조 심사청구에 대한 결정

외국인보호위원회는 제69조제2항에 따라 청장ㆍ사무소장ㆍ출장소장 또는 보호소장으로부터 심사청구서를 받은 날부터 3주 이내에 심사청구에 대한 결정을 해야 한다. 다만, 부득이한 사정이 있는 경우에는 2주의 범위에서 한 차례만 그 기간을 연장할 수 있다.

The Foreigner Protection Committee shall make a decision on the request for review within 3 weeks from the date of receiving the request for review from the Commissioner, Director of the Office, Director of the Branch Office, or Director of the Protection Office pursuant to Article 69 (2). However, if there are unavoidable circumstances, the period may be extended once within the scope of 2 weeks.

외국인보호위원회는 심사청구에 대한 결정을 한 때에는 주문(主文)ㆍ이유 및 적용 법조문 등을 적은 심사청구에 대한 결정서를 작성하여 청장ㆍ사무소장ㆍ출장소장 또는 보호소장과 법무부장관에게 알려야 한다.

When the Foreigner Protection Committee makes a decision on the request for review, it shall prepare a decision document on the request for review stating the order, reasons, and applicable laws, and notify the Commissioner, Director of the Office, Director of the Branch Office, or Director of the Protection Office, and the Minister of Justice.

제2항에 따라 통보받은 청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 심사청구에 대한 결정서를 심사청구인에게 보내야 한다.

The Commissioner, Director of the Office, Director of the Branch Office, or Director of the Protection Office, who has been notified pursuant to paragraph ②, shall send the decision document on the request for review to the requester.

청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 법 제55조제2항에 따라 외국인보호위원회가 심사청구에 대해 보호해제하는 결정을 하면 지체 없이 보호를 해제해야 한다. 이 경우 보호해제되는 사람을 보호하고 있는 보호시설의 장에게 보호해제 의뢰서를 보내야 한다.

When the Foreigner Protection Committee decides to release from protection concerning the request for review pursuant to Article 55 (2) of the Act, the Commissioner, Director of the Office, Director of the Branch Office, or Director of the Protection Office shall immediately release from protection. In this case, a release request shall be sent to the head of the protection facility where the person to be released from protection is being held.
