Article 78-3 (Release from Protection upon Order of Compelled Removal)
제78조의3 강제퇴거명령을 받은 사람의 보호해제

청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 법 제63조의2제1항부터 제3항까지의 규정에 따라 보호를 해제하는 때에는 그 해제 사유와 같은 조 제4항에 따른 보호해제 조건(조건을 붙이는 경우로 한정한다)을 적은 보호해제 통보서를 피보호자에게 내주어야 한다. 이 경우 청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 피보호자를 보호하고 있는 보호시설의 장에게 보호해제 의뢰서를 보내야 한다.
The head of an immigration office, the head of an office, the head of a branch office, or the head of a detention center shall issue a written notice of release from protection to the person under protection, stating the grounds for release pursuant to Articles 63-2(1) through (3) of the Act, and the conditions for release from protection pursuant to Article 63-2(4) of the Act (limited to cases where conditions are attached). In this case, the head of an immigration office, the head of an office, the head of a branch office, or the head of a detention center shall send a written request for release from protection to the head of the facility where the person under protection is being held.
법 제63조의2제4항에 따라 보호해제를 하면서 보증금을 납부하도록 조건을 붙이는 경우 그에 대한 통보 및 보증금의 예치 등의 절차에 관하여는 제17조제2항을 준용한다.
When attaching a condition to pay a deposit upon release from protection pursuant to Article 63-2(4) of the Act, the procedures concerning notification and deposit of the guarantee money shall be applied mutatis mutandis to Article 17(2).
청장ㆍ사무소장ㆍ출장소장 또는 보호소장은 법 제63조의2제1항부터 제3항까지의 규정에 따라 보호가 해제된 사람에 대하여 같은 조 제4항에 따른 조건의 이행 여부 등 동향을 파악해야 한다.
The head of an immigration office, the head of an office, the head of a branch office, or the head of a detention center shall ascertain the status of persons released from protection pursuant to Articles 63-2(1) through (3) of the Act, including whether they have fulfilled the conditions pursuant to Article 63-2(4) of the Act.
