제88조의5 관리비용의 부담 및 납부 절차

국가는 법 제76조의3제1항에 따라 송환대상외국인이 출국하기 전까지 다음 각 호의 물품을 제공하는 데 드는 비용(이하 "관리비용"이라 한다)을 부담한다. 다만, 법 제76조의2제1항 단서에 따라 송환대상외국인의 신청으로 송환대기장소를 변경한 경우에는 부담하지 않는다.
1. 침구
2. 생활용품
3. 음식물
4. 그 밖에 송환대상외국인의 송환대기에 필요한 물품
The State shall bear the costs incurred for providing the goods listed in the following subparagraphs until the alien subject to repatriation departs, pursuant to Article 76-3 (1) of the Act (hereinafter referred to as "management costs"). However, the State shall not bear such costs when the repatriation waiting place has been changed at the request of the alien subject to repatriation pursuant to the proviso to Article 76-2 (1) of the Act. 1. Bedding 2. Daily necessities 3. Food 4. Other goods necessary for the repatriation waiting of the alien subject to repatriation
제1항 각 호의 물품을 제공하는 방법 및 세부기준은 법무부장관이 정하여 고시한다.
The method and detailed standards for providing the goods listed in the subparagraphs of paragraph ① shall be determined and publicly notified by the Minister of Justice.
청장ㆍ사무소장 또는 출장소장은 법 제76조의3제2항에 따라 관리비용을 선박등의 장 또는 운수업자가 부담하게 하려는 경우에는 송환대상외국인이 출국대기실에서 퇴실하였을 때에 다음 각 호의 사항이 기재된 납부고지서를 발급하여야 한다. 다만, 관리 기간이 1개월을 초과하는 경우에는 1개월 단위로 발급할 수 있다.

2. 관리비용 청구사유
3. 납부금액 및 산출근거
4. 납부기한
5. 납부방법
6. 미납 시 조치 예정 사항
When the head of the port, office, or branch office intends to have the master of a vessel, etc. or the transportation business operator bear the management costs pursuant to Article 76-3 (2) of the Act, they shall issue a notice of payment, stating the matters listed in the following subparagraphs, when the alien subject to repatriation has left the departure waiting room. However, if the management period exceeds one month, it may be issued on a monthly basis. 1. Name of payer 2. Reason for claiming management costs 3. Amount payable and basis for calculation 4. Payment deadline 5. Method of payment 6. Measures to be taken in case of non-payment
제3항에 따른 관리비용의 범위 및 세부기준에 관하여는 제1항 각 호 외의 부분 본문, 같은 항 각 호 및 제2항을 준용한다.
The scope and detailed standards of management costs under paragraph ③ shall apply mutatis mutandis to the main clause of each subparagraph of paragraph ①, each subparagraph of the same paragraph, and paragraph ②.
법무부장관은 제3항에 따른 납부고지서 발급 등을 위하여 필요한 정보통신망을 구축ㆍ운영할 수 있다.
The Minister of Justice may establish and operate the necessary information and communication networks for issuing the notice of payment under paragraph ③ and other related matters.
