제48조의2 모바일외국인등록증의 발급 등

법 제33조제6항에 따른 모바일외국인등록증을 발급 또는 재발급받으려는 사람은 체류지를 관할하는 청장ㆍ사무소장 또는 출장소장에게 별지 제34호의9서식의 신청서를 제출하고 여권 또는 외국인등록증(영주증을 포함한다. 이하 이 조에서 같다)을 제시해야 한다. 다만, 제6항에 따라 모바일외국인등록증 발급에 필요한 보안사항을 전자적 방식으로 저장한 집적회로(IC, Integrated Circuit) 칩이 내장된 외국인등록증을 소지한 사람은 모바일외국인등록증을 발급받으려는 이동통신단말장치(「이동통신단말장치 유통구조 개선에 관한 법률」 제2조제4호에 따른 이동통신단말장치를 말한다. 이하 같다)를 통해 신청할 수 있다.
A person who intends to be issued or reissued a mobile alien registration card under Article 33 (6) of the Act shall submit an application form in Form No. 34-9 of the attached forms to the head of the competent immigration office, branch office, or sub-branch office having jurisdiction over his/her place of sojourn, and present his/her passport or alien registration card (including an alien permanent resident card; hereinafter the same applies in this Article). However, a person who holds an alien registration card with an integrated circuit (IC) chip embedded, on which security information necessary for the issuance of a mobile alien registration card is electronically stored under Paragraph 6, may apply through the mobile communication terminal device (referring to a mobile communication terminal device as defined in Article 2 (4) of the 「Act on Promotion of Mobile Communication Terminal Device Distribution Structure Improvement」; hereinafter the same applies) that he/she is using.
모바일외국인등록증의 유효기간은 체류기간 만료일(영주증을 모바일로 발급받은 경우에는 영주증 유효기간 만료일)까지로 한다.
The validity period of a mobile alien registration card shall be until the expiration date of the period of sojourn (or until the expiration date of the alien permanent resident card, if the alien permanent resident card is issued in a mobile format).
모바일외국인등록증은 외국인 본인이 사용하고 있는 이동통신단말장치 중 1대에만 발급받을 수 있고, 외국인등록증과 동일한 내용의 정보를 수록한다.
A mobile alien registration card may only be issued to one mobile communication terminal device being used by the alien, and shall contain the same information as the alien registration card.
모바일외국인등록증은 다음 각 호의 어느 하나에 해당하는 경우 재발급받을 수 있다.
1. 영 제42조제1항 또는 제42조의2제1항에 따라 외국인등록증 또는 영주증을 재발급받은 경우
2. 외국인 본인이 사용하고 있는 이동통신단말장치를 변경한 경우
3. 그 밖에 모바일외국인등록증의 사용이 불가능해 재발급이 필요한 경우
A mobile alien registration card may be reissued in any of the following cases: 1. When the alien registration card or alien permanent resident card is reissued under Article 42 (1) or Article 42-2 (1) of the Enforcement Decree. 2. When the alien changes the mobile communication terminal device he/she is using. 3. In any other case where reissuance is necessary due to the mobile alien registration card becoming unusable.
모바일외국인등록증의 효력을 말소할 수 있는 사유는 다음 각 호와 같다.
1. 법 제37조에 따라 외국인등록증이 반납되거나 법 제37조의2에 따라 외국인등록사항이 말소된 경우
2. 영 제42조제1항 또는 제42조의2제1항에 따라 외국인등록증 또는 영주증을 재발급받은 경우
3. 모바일외국인등록증이 설치된 이동통신단말장치가 분실되거나 사용할 수 없게 되어 모바일외국인등록증의 효력을 말소할 필요가 있는 경우
4. 부정한 방법으로 모바일외국인등록증을 발급받은 경우
5. 그 밖에 제1호부터 제4호까지에 준하는 경우로서 청장ㆍ사무소장 또는 출장소장이 모바일외국인등록증의 효력을 말소할 필요가 있다고 인정하는 경우
The grounds for invalidating the effect of a mobile alien registration card shall be as follows: 1. When the alien registration card is returned under Article 37 of the Act, or when the alien registration details are cancelled under Article 37-2 of the Act. 2. When the alien registration card or alien permanent resident card is reissued under Article 42 (1) or Article 42-2 (1) of the Enforcement Decree. 3. When the mobile alien registration card is lost or becomes unusable on the mobile communication terminal device where it is installed, and it is necessary to invalidate its effect. 4. When the mobile alien registration card is obtained by fraudulent means. 5. In any other case equivalent to subparagraphs 1 through 4, where the head of the immigration office, branch office, or sub-branch office recognizes the need to invalidate the effect of the mobile alien registration card.
청장ㆍ사무소장 또는 출장소장은 모바일외국인등록증 발급에 필요한 보안사항을 전자적 방식으로 저장한 집적회로 칩이 내장된 외국인등록증을 발급할 수 있다.
The head of the immigration office, branch office, or sub-branch office may issue an alien registration card with an integrated circuit (IC) chip embedded, on which security information necessary for the issuance of a mobile alien registration card is electronically stored.
법무부장관은 모바일외국인등록증의 발급ㆍ재발급ㆍ관리 및 진위확인 등을 위해 「전자정부법 시행령」 제12조제4항에 따른 신원확인에 공통적으로 적용되는 운영기반을 이용할 수 있다.
The Minister of Justice may utilize the operational infrastructure commonly applied for identity verification under Article 12 (4) of the 「Enforcement Decree of the Electronic Government Act」 for the issuance, reissuance, management, and verification of authenticity of mobile alien registration cards.
제1항부터 제7항까지에서 규정한 사항 외에 모바일외국인등록증의 발급 등에 필요한 사항은 법무부장관이 정한다.
Matters concerning the issuance of mobile alien registration cards, etc., other than those prescribed in Paragraphs 1 through 7, shall be determined by the Minister of Justice.
