제67조 출입항통보 및 보고

선박등의 장 또는 운수업자는 선박등이 자연의 재해ㆍ기기의 고장ㆍ피난 기타 부득이한 사유로 영 제86조에 따른 출입항예정통보를 하지 아니하고 출입국항 또는 출입국항외의 장소에 입항한 때에는 그 선박등이 입항한 즉시 청장ㆍ사무소장 또는 출장소장에게 입항통보를 하여야 한다. <개정 1999.2.27, 2018.5.15>
The captain of a vessel, etc. or a carrier shall immediately notify the Commissioner, the Head of the Office, or the Head of the Branch Office of the arrival of the vessel, etc. when it arrives at a port of entry/exit or a place outside a port of entry/exit without prior notification of arrival and departure pursuant to Article 86 of the Enforcement Decree, due to natural disaster, equipment malfunction, seeking refuge, or other unavoidable circumstances. <Amended by Act No. 5749, Feb. 27, 1999; Act No. 15548, May 15, 2018>
선박등의 장 또는 운수업자는 법 제74조에 따른 출입항예정통보서와 법 제75조에 따른 출입항보고서를 정보화망을 이용하여 제출하는 때에는 표준전자문서를 사용하여 청장ㆍ사무소장 또는 출장소장에게 전송하여야 한다. <신설 1999.2.27, 2005.7.8, 2018.5.15>
When submitting a prior notification of arrival and departure under Article 74 of the Act and a report of arrival and departure under Article 75 of the Act using an information network, the captain of a vessel, etc. or a carrier shall transmit them to the Commissioner, the Head of the Office, or the Head of the Branch Office using a standardized electronic document. <Newly added by Act No. 5749, Feb. 27, 1999; Act No. 12706, Jul. 8, 2005; Act No. 15548, May 15, 2018>
법 제75조제2항 단서에서 "부득이한 사유로 인하여 표준화된 전자문서로 제출할 수 없는 때"라 함은 다음 각 호의 어느 하나에 해당하는 때를 말한다. <신설 2005.7.8, 2018.5.15>
1. 천재지변ㆍ정전 또는 이에 준하는 사유로 정보시스템 또는 통신장애가 발생한 때
2. 청장ㆍ사무소장 또는 출장소장과 출입국항에 출입항하는 항공기의 장 또는 항공기에 관한 사업을 영위하는 운수업자간에 표준전자문서를 송ㆍ수신할 수 있는 시스템이 구축되지 아니한 경우로서 청장ㆍ사무소장 또는 출장소장이 정당한 사유가 있다고 인정하는 때
In the proviso of Article 75(2) of the Act, "when unable to submit a standardized electronic document due to unavoidable circumstances" means any of the following cases. <Newly added by Act No. 12706, Jul. 8, 2005; Act No. 15548, May 15, 2018> 1. When information system or communication failures occur due to natural disasters, power outages, or similar reasons. 2. When a system capable of transmitting and receiving standardized electronic documents between the Commissioner, the Head of the Office, or the Head of the Branch Office and the captain of an aircraft, etc. or a carrier operating business related to aircraft, etc. entering or departing from a port of entry/exit has not been established, and the Commissioner, the Head of the Office, or the Head of the Branch Office recognizes that there is a justifiable reason.
