제12조 입국심사

외국인이 입국하려는 경우에는 입국하는 출입국항에서 대통령령으로 정하는 바에 따라 여권과 입국신고서를 출입국관리공무원에게 제출하여 입국심사를 받아야 한다. <개정 2020.6.9>
A foreign national who intends to enter shall submit their passport and an entry report to an immigration control official at the port of entry and departure through which they enter, and undergo entry inspection, as prescribed by Presidential Decree. <Amended on Jun. 9, 2020>
제1항에 관하여는 제6조제1항 단서 및 같은 조 제3항을 준용한다.
The proviso to Article 6 (1) and Article 6 (3) shall apply mutatis mutandis to paragraph (1).
출입국관리공무원은 입국심사를 할 때에 다음 각 호의 요건을 갖추었는지를 심사하여 입국을 허가한다. <개정 2020.2.4>
1. 여권과 사증이 유효할 것. 다만, 사증은 이 법에서 요구하는 경우만을 말한다.
1의2. 제7조의3제2항에 따른 사전여행허가서가 유효할 것
2. 입국목적이 체류자격에 맞을 것
3. 체류기간이 법무부령으로 정하는 바에 따라 정하여졌을 것
4. 제11조에 따른 입국의 금지 또는 거부의 대상이 아닐 것
When conducting entry inspection, an immigration control official shall examine whether the following requirements are met and shall then permit entry: <Amended on Feb. 4, 2020> 1. The passport and visa are valid. Provided, That a visa is required only where this Act so requires. 1-2. The pre-travel authorisation under Article 7-3 (2) is valid 2. The purpose of entry accords with the status of stay 3. The period of stay has been determined as prescribed by Ordinance of the Ministry of Justice 4. The person is not subject to prohibition or refusal of entry under Article 11
출입국관리공무원은 외국인이 제3항 각 호의 요건을 갖추었음을 증명하지 못하면 입국을 허가하지 아니할 수 있다.
An immigration control official may refuse to permit entry where a foreign national fails to prove that the requirements under the subparagraphs of paragraph (3) are met.
출입국관리공무원은 제7조제2항제2호 또는 제3호에 해당하는 사람에게 입국을 허가할 때에는 대통령령으로 정하는 바에 따라 체류자격을 부여하고 체류기간을 정하여야 한다.
When permitting entry to a person falling under Article 7 (2) 2 or 3, an immigration control official shall grant a status of stay and determine a period of stay, as prescribed by Presidential Decree.
출입국관리공무원은 제1항이나 제2항에 따른 심사를 하기 위하여 선박등에 출입할 수 있다.
An immigration control official may board a vessel or other conveyance in order to conduct an inspection under paragraph (1) or (2).
