제12조의2 입국 시 생체정보의 제공 등

입국하려는 외국인은 제12조에 따라 입국심사를 받을 때 법무부령으로 정하는 방법으로 생체정보를 제공하고 본인임을 확인하는 절차에 응하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 사람은 그러하지 아니하다. <개정 2020.6.9>
1. 17세 미만인 사람
2. 외국정부 또는 국제기구의 업무를 수행하기 위하여 입국하는 사람과 그 동반 가족
3. 외국과의 우호 및 문화교류 증진, 경제활동 촉진 또는 대한민국의 이익 등을 고려하여 생체정보의 제공을 면제하는 것이 필요하다고 대통령령으로 정하는 사람
A foreign national intending to enter shall, when undergoing entry inspection under Article 12, provide biometric information by the method prescribed by Ordinance of the Ministry of Justice and comply with identity verification procedures. This shall not apply, however, to a person falling under any of the following: <Amended on Jun. 9, 2020> 1. A person under 17 years of age 2. A person entering to perform the duties of a foreign government or an international organisation, and their accompanying family 3. A person prescribed by Presidential Decree for whom exemption from providing biometric information is deemed necessary in light of promoting friendship and cultural exchange with other countries, facilitating economic activity, or the interests of the Republic of Korea
출입국관리공무원은 외국인이 제1항 본문에 따라 생체정보를 제공하지 아니하는 경우에는 그의 입국을 허가하지 아니할 수 있다. <개정 2020.6.9>
An immigration control official may refuse to permit entry where a foreign national does not provide biometric information under the main clause of paragraph (1). <Amended on Jun. 9, 2020>
법무부장관은 입국심사에 필요한 경우에는 관계 행정기관이 보유하고 있는 외국인의 생체정보의 제출을 요청할 수 있다. <개정 2020.6.9>
Where necessary for entry inspection, the Minister of Justice may request relevant administrative agencies to submit biometric information of foreign nationals in their possession. <Amended on Jun. 9, 2020>
제3항에 따라 협조를 요청받은 관계 행정기관은 정당한 이유 없이 그 요청을 거부하여서는 아니 된다.
A relevant administrative agency requested to cooperate under paragraph (3) shall not refuse the request without justifiable grounds.
출입국관리공무원은 제1항 또는 제3항에 따라 제공 또는 제출받은 생체정보를 입국심사에 활용할 수 있다. <개정 2020.6.9>

법무부장관은 제1항 또는 제3항에 따라 제공 또는 제출받은 생체정보를 「개인정보 보호법」에 따라 보유하고 관리한다. <개정 2011.3.29, 2020.6.9>
