출입국관리공무원은 관광을 목적으로 대한민국과 외국 해상을 국제적으로 순회(巡廻)하여 운항하는 여객운송선박 중 법무부령으로 정하는 선박에 승선한 외국인승객에 대하여 그 선박의 장 또는 운수업자가 상륙허가를 신청하면 3일의 범위에서 승객의 관광상륙을 허가할 수 있다. 다만, 제11조제1항 각 호의 어느 하나에 해당하는 외국인승객에 대하여는 그러하지 아니하다.
An immigration control official may, upon application for landing permission by the captain of the vessel or the carrier, permit foreign passengers aboard a passenger vessel prescribed by Ordinance of the Ministry of Justice that cruises internationally between the Republic of Korea and foreign waters for tourism purposes to land as tourists for a period not exceeding three days. This shall not apply, however, to a foreign passenger falling under any subparagraph of Article 11 (1).
출입국관리공무원은 제1항에 따른 상륙허가 신청을 받으면 다음 각 호의 서류를 확인하여야 한다.
1. 외국인승객의 여권
2. 외국인승객의 명부
3. 그 밖에 법무부령으로 정하는 서류
Upon receiving an application for landing permission under paragraph (1), an immigration control official shall verify the following documents: 1. The foreign passengers' passports 2. The list of foreign passengers 3. Any other documents prescribed by Ordinance of the Ministry of Justice
제1항에 따른 관광상륙허가의 허가서 및 상륙허가기간의 연장에 관하여는 제14조제3항 및 제5항을 준용한다. 이 경우 "승무원 상륙허가서"는 "관광상륙허가서"로, "승무원 상륙허가"는 "관광상륙허가"로, "외국인승무원"은 "외국인승객"으로 본다.
Article 14 (3) and (5) shall apply mutatis mutandis to the written permit for tourist landing permission under paragraph (1) and to the extension of the period of landing permission. In such cases, "written crew landing permit" shall be read as "written tourist landing permit", "crew landing permission" as "tourist landing permission", and "foreign crew member" as "foreign passenger".
제1항에 따른 관광상륙허가를 받으려는 외국인승객의 지문 및 얼굴에 관한 정보 제공 등에 관하여는 제12조의2를 준용한다. 다만, 외국인승객의 관광상륙허가 절차상 지문 및 얼굴에 관한 정보의 제공이 곤란한 경우에는 그러하지 아니하다.
Article 12-2 shall apply mutatis mutandis to the provision of fingerprint and facial information of foreign passengers seeking tourist landing permission under paragraph (1). This shall not apply, however, where providing fingerprint and facial information is impracticable in the tourist landing permission procedure.
제1항부터 제4항까지에서 규정한 사항 외에 관광상륙허가의 기준과 절차에 관하여 필요한 사항은 대통령령으로 정한다.
Matters necessary for the criteria and procedures for tourist landing permission, other than those provided in paragraphs (1) through (4), shall be prescribed by Presidential Decree.
