외국인이 입국한 날부터 90일을 초과하여 대한민국에 체류하려면 대통령령으로 정하는 바에 따라 입국한 날부터 90일 이내에 그의 체류지를 관할하는 지방출입국ㆍ외국인관서의 장에게 외국인등록을 하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 외국인의 경우에는 그러하지 아니하다. <개정 2014.3.18>
1. 주한외국공관(대사관과 영사관을 포함한다)과 국제기구의 직원 및 그의 가족
2. 대한민국정부와의 협정에 따라 외교관 또는 영사와 유사한 특권 및 면제를 누리는 사람과 그의 가족
3. 대한민국정부가 초청한 사람 등으로서 법무부령으로 정하는 사람
Any alien who intends to stay in the Republic of Korea for more than 90 days from the date of entry shall register as an alien with the head of the competent immigration office having jurisdiction over his/her place of sojourn within 90 days from the date of entry, in accordance with Presidential Decrees: Provided, That this shall not apply to aliens falling under any of the following subparagraphs. <Amended by Act No. 12415, Mar. 18, 2014> 1. Officials of foreign diplomatic missions in Korea (including embassies and consulates) and international organizations, and their families 2. Persons and their families who enjoy privileges and immunities similar to diplomatic or consular officials by agreement with the Government of the Republic of Korea 3. Persons invited by the Government of the Republic of Korea, etc., as prescribed by Decrees of the Minister of Justice
제1항에도 불구하고 같은 항 각 호의 어느 하나에 해당하는 외국인은 본인이 원하는 경우 체류기간 내에 외국인등록을 할 수 있다. <신설 2016.3.29>
Notwithstanding the provisions of paragraph ①, aliens falling under any of the subparagraphs of the same paragraph may register as aliens within their period of sojourn if they wish. <Newly Inserted by Act No. 13945, Mar. 29, 2016>
제23조에 따라 체류자격을 받는 사람으로서 그 날부터 90일을 초과하여 체류하게 되는 사람은 제1항 각 호 외의 부분 본문에도 불구하고 체류자격을 받는 때에 외국인등록을 하여야 한다. <개정 2016.3.29>
Persons who obtain a status of sojourn pursuant to Article 23 and are expected to stay for more than 90 days from that day shall register as aliens at the time of obtaining their status of sojourn, notwithstanding the main sentence of paragraph ①, excluding the proviso. <Amended by Act No. 13945, Mar. 29, 2016>
제24조에 따라 체류자격 변경허가를 받는 사람으로서 입국한 날부터 90일을 초과하여 체류하게 되는 사람은 제1항 각 호 외의 부분 본문에도 불구하고 체류자격 변경허가를 받는 때에 외국인등록을 하여야 한다. <개정 2016.3.29>
Persons who obtain permission for change of status of sojourn pursuant to Article 24 and are expected to stay for more than 90 days from the date of entry shall register as aliens at the time of obtaining permission for change of status of sojourn, notwithstanding the main sentence of paragraph ①, excluding the proviso. <Amended by Act No. 13945, Mar. 29, 2016>
지방출입국ㆍ외국인관서의 장은 제1항부터 제4항까지의 규정에 따라 외국인등록을 한 사람에게는 대통령령으로 정하는 방법에 따라 개인별로 고유한 등록번호(이하 "외국인등록번호"라 한다)를 부여하여야 한다. <개정 2014.3.18, 2016.3.29>
