제38조 생체정보의 제공 등

다음 각 호의 어느 하나에 해당하는 외국인은 법무부령으로 정하는 바에 따라 생체정보를 제공하여야 한다. <개정 2016.3.29, 2020.6.9>
1. 다음 각 목의 어느 하나에 해당하는 사람으로서 17세 이상인 사람
- 가. 제31조에 따라 외국인등록을 하여야 하는 사람(같은 조 제2항에 따라 외국인등록을 하려는 사람은 제외한다)
- 나. 「재외동포의 출입국과 법적 지위에 관한 법률」 제6조에 따라 국내거소신고를 하려는 사람
2. 이 법을 위반하여 조사를 받거나 그 밖에 다른 법률을 위반하여 수사를 받고 있는 사람
3. 신원이 확실하지 아니한 사람
4. 제1호부터 제3호까지에서 규정한 사람 외에 법무부장관이 대한민국의 안전이나 이익 또는 해당 외국인의 안전이나 이익을 위하여 특히 필요하다고 인정하는 사람
A foreign national who falls under any of the following subparagraphs shall provide biometric information as prescribed by the Ordinance of the Ministry of Justice. <Amended by Act No. 13190, Mar. 29, 2016, Act No. 17349, Jun. 9, 2020> 1. A person who falls under any of the following items and is 17 years of age or older: a. A person who is required to register as a foreign national under Article 31 (excluding a person who intends to register as a foreign national under paragraph (2) of the same Article) b. A person who intends to report their place of residence in the Republic of Korea under Article 6 of the Act on the Entry and Sojourn of Foreigners of Korean Nationality and Their Legal Status in the Republic of Korea 2. A person who is being investigated for violating this Act or is under investigation for violating other laws 3. A person whose identity is not certain 4. In addition to the persons prescribed in subparagraphs 1 through 3, a person whom the Minister of Justice deems particularly necessary for the safety or interests of the Republic of Korea or for the safety or interests of the foreign national concerned
지방출입국ㆍ외국인관서의 장은 제1항에 따른 생체정보의 제공을 거부하는 외국인에게는 체류기간 연장허가 등 이 법에 따른 허가를 하지 아니할 수 있다. <개정 2014.3.18, 2020.6.9>
The head of a regional immigration office or foreign affairs office may refuse to grant permission under this Act, such as permission for extension of period of stay, to a foreign national who refuses to provide biometric information under paragraph (1). <Amended by Act No. 12404, Mar. 18, 2014, Act No. 17349, Jun. 9, 2020>
법무부장관은 제1항에 따라 제공받은 생체정보를 「개인정보 보호법」에 따라 보유하고 관리한다. <개정 2011.3.29, 2020.6.9>
