Article 48 (Summons and Interrogation of Suspects)
제48조 용의자에 대한 출석요구 및 신문

출입국관리공무원은 제47조에 따른 조사에 필요하면 용의자의 출석을 요구하여 신문(訊問)할 수 있다.
An immigration control officer may, if necessary for an investigation under Article 47, summon a suspect and interrogate him or her.
출입국관리공무원이 제1항에 따라 신문을 할 때에는 다른 출입국관리공무원을 참여하게 하여야 한다.
When an immigration control officer conducts an interrogation under paragraph ①, another immigration control officer shall be present.
제1항에 따른 신문을 할 때에는 용의자가 한 진술은 조서(調書)에 적어야 한다.
When an interrogation under paragraph ① is conducted, the statements made by the suspect shall be recorded in a written record.
출입국관리공무원은 제3항에 따른 조서를 용의자에게 읽어 주거나 열람하게 한 후 오기(誤記)가 있고 없음을 물어야 하고, 용의자가 그 내용에 대한 추가ㆍ삭제 또는 변경을 청구하면 그 진술을 조서에 적어야 한다.
An immigration control officer shall read or allow the suspect to inspect the written record under paragraph ③ and ask whether there are any errors; if the suspect requests any additions, deletions, or changes to the content, such statements shall be recorded in the written record.
조서에는 용의자로 하여금 간인(間印)한 후 서명 또는 기명날인(記名捺印)하게 하고, 용의자가 서명 또는 기명날인할 수 없거나 이를 거부할 때에는 그 사실을 조서에 적어야 한다.
The suspect shall affix his or her signature or registered seal after interlining the written record, and if the suspect cannot sign or affix his or her registered seal, or refuses to do so, such fact shall be recorded in the written record.
국어가 통하지 아니하는 사람이나 청각장애인 또는 언어장애인의 진술은 통역인에게 통역하게 하여야 한다. 다만, 청각장애인이나 언어장애인에게는 문자로 묻거나 진술하게 할 수 있다.
When a person who does not understand the Korean language, or a deaf person or a person with a speech impediment makes a statement, an interpreter shall interpret. However, a deaf person or a person with a speech impediment may be asked questions or make statements in writing.
용의자의 진술 중 국어가 아닌 문자나 부호가 있으면 이를 번역하게 하여야 한다.
If the suspect's statements contain characters or symbols other than Korean, they shall be translated.
